ATTY/RESO.0020/PC RESO GRANTING APPROVAL OF PERMITS FOR 150 CHARTER <br />REV: 04-29-2021 PR <br />Page 1 of 20 <br />RESOLUTION NO. 21-02 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />REDWOOD CITY GRANTING APPROVAL OF A PLANNED <br />DEVELOPMENT PERMIT, CONDOMINIUM PERMIT, TENTATIVE MAP, <br />AND ARCHITECTURAL PERMIT FOR THE 150 CHARTER PROJECT <br />AND FINDING THAT THE PROJECT IS EXEMPT FROM THE <br />REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY <br />ACT <br />WHEREAS, LMT Home Corporation (the Applicant) submitted an application for <br />an Planned Development Permit (PD2019-007), Condominium Permit (CP2019-006), <br />Tentative Map (TM2018-010), and Architectural Permit (AP2018-085), to construct a four- <br />story, 72 unit residential building (the Project) located at 150 Charter Street, which is within <br />the Mixed-Use Corridor – El Camino Real (MUC-ECR) District; and <br />WHEREAS, on March 4, 2021, the Architectural Advisory Committee (AAC) of the <br />City of Redwood City conducted a public hearing to consider the proposed project and <br />voted 5-0 to recommend that the Planning Commission (the Commission) approve the <br />Project; and <br />WHEREAS, the Planning Commission of the City of Redwood City (“Commission)” <br />is empowered by the Redwood City Zoning Ordinance to act upon applications for <br />Architectural Permits, Planned Development Permits, and is empowered by the <br />Subdivision Map Act and the Redwood City Municipal Code, to act upon applications for <br />Tentative Map and Condominium Permit applications; and <br />WHEREAS, on May 4, 2021, the Commission conducted a duly noticed public <br />hearing, in accordance with all applicable requirements of the State Planning and Zoning <br />Law, the Redwood City Code, and the Redwood City Zoning Ordinance, to consider <br />the Project; and <br />WHEREAS, the Commission considered the staff reports, oral and written <br />testimony and materials presented by all those wishing to be heard on the Project; and <br />WHEREAS, the Commission considered whether the Project is categorically <br />exempt from the requirements of the California Environmental Quality Act (CEQA), <br />pursuant to CEQA Guidelines Section 15332 (Class 32 - “Infill Development”) as explained <br />in the CEQA compliance memorandum attached to the staff report (“CEQA <br />Memorandum”); and <br />WHEREAS, the Commission has determined that the proposed Project is <br />consistent with the General Plan goals and Zoning District standards and other applicable <br />provisions of the Redwood City Municipal Code and Zoning Ordinance, and Subdivision <br />Map Act. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF REDWOOD CITY AS FOLLOWS: <br />Section 1. The Commission, having independently heard, considered and <br />weighed all the evidence in the record, finds that the above recitals are accurate and <br />constitute findings in this matter and, together with the staff report and the application <br />materials, including without limitation the CEQA determination, development plans, and <br />all other documents, reports, studies, memoranda, maps, oral and written testimony, and
