ATTY/RESO.0073/PC RESO 239 VERA AVE <br />REV: 09-24-2021 VR <br />Page 2 of 16 <br />in the City's file for the applications and the Project, and all adopted City planning <br />documents relating to the Project and the property including the City's General Plan, <br />Zoning Ordinance, Municipal Code, other applicable City laws and regulations, and all <br />associated approved and certified environmental documents, have together served as an <br />adequate and appropriate evidentiary basis for the findings and actions set forth in this <br />resolution. <br />Section 2. The Commission finds that, based on substantial evidence in the <br />administrative record, including but not limited to the CEQA Memorandum, the Project is <br />Categorically Exempt pursuant to CEQA Guidelines section 15332 (Class 32) for Infill <br />Development Projects. Specifically, the project complies with each required condition of <br />the exemption as: <br />a. The Project is consistent with the General Plan designation and applicable <br />Zoning Ordinance regulations, as set forth in the staff report and its <br />attachments; and <br /> <br />b. The proposed development occurs within city limits on a project site of no <br />more than five acres substantially surrounded by urban uses, in that the Project <br />nearby uses include Sequoia Station in close proximity of approximately less <br />than a mile, and <br /> <br />c. The project site has no value as habitat for endangered species, in that the <br />project site is located in in a highly urbanized area, and is completely paved ; <br />and <br /> <br />d. Approval of the Project would not result in significant effects related to traffic, <br />noise, air quality, or water quality, because the project is located in a transit <br />priority area and exempt from additional CEQA transportation analysis, and the <br />conditions of approval, or other existing regulations, would address concerns <br />related to air quality, noise, or water quality; and <br /> <br />e. The site can be adequately served by all required utilities and public <br />services. <br /> <br />In addition, none of the exceptions under CEQA Guidelines section 15300.2 apply <br />specifically; <br /> <br />1) As a stand-alone project, there is no cumulative impact of successive <br />projects of the same type in the same place, over time, <br /> <br />2) There is no reasonable possibility that the activity will have a significant <br />effect on the environment due to unusual circumstances because no unusual <br />circumstances exist on the project site or surrounding area, as described in the <br />staff report, <br />
