ATTY/RESO.0073/PC RESO 239 VERA AVE <br />REV: 09-24-2021 VR <br />Page 3 of 16 <br />3) There is no potential for an impact to scenic resources within a highway <br />officially designated as a state scenic highway because there is not a <br />designated highway in the vicinity of the Project, <br /> <br />4) The Project is not included on any list compiled pursuant to Section 65962.5 <br />of the Government Code because site remediation has been complete and Case <br />Closure Letter issued by San Mateo County on March 6, 2012, and <br /> <br />5) There will be no substantial adverse change in the significance of a historical <br />resource because the site does not contain any historic resources. <br /> <br />Pursuant to CEQA Guidelines Section 15091(e), the documents and other materials that <br />constitute the record of proceedings upon which the Commission has based its decision <br />are located in and may be obtained from, the Office of the City Clerk at 1017 Middlefield <br />Road, Redwood City California. The City Clerk is the custodian of records for all matters <br />before the City. <br /> <br />Section 3. Condominium Permit CP2020-001. The Commission finds that: <br /> <br />a. Permit Finding. Pursuant to Municipal Code Chapter 30 (Subdivisions) <br /> <br />Pursuant to Article XI (Condominiums) the Project requires approval of a <br />Condominium Permit. Municipal Code Section 30.130 states: “While <br />condominium and community apartment projects present benefits in the nature <br />of increased amenities, opportunities for dwelling ownership and leisure time, <br />the special nature of such projects creates conditions that may result in neglect, <br />deterioration and lack of maintenance, causing a negative impact upon the <br />public health, safety, welfare and economic prosperity of the City and its citizens. <br />Because of the unique nature of the problems created by condominium and <br />community apartment projects, it is the express intent of the City to treat such <br />projects differently from other types of multiple-family dwellings and to establish <br />rules and standards therefor, regulating the construction of, and conversion to, <br />condominium projects and community apartment projects in the City.” <br /> <br />The Project as proposed complies with the requirements of Article XI of the <br />Subdivision Ordinance because, among other reasons, the project proposes <br />meter and control valves, noise and energy insulation as required and the <br />Project is consistent with the applicable provisions of the Zoning Ordinance and <br />General Plan designation for the site. <br /> <br />Section 4. Tentative Map TM2020-001: The Project requires approval of a <br />Tentative Map per the Subdivision Ordinance.
