Findings and Statements Required by the California Environmental Quality Act <br />Harbor View Project PAGE 24 OF 48 ESA / 170951 <br />Final Environmental Impact Report October 2022 <br />ATTY/RESO.0085/PC RESO RECOMMENDING CEQA – EXHIBIT A <br />REV: 11-02-2022 VR <br />existing ground surface within the protected perimeter activities; implementing special measures <br />to allow the roots to breathe and obtain water and nutrients; ensuring no storage or dumping of oil, <br />gas, chemicals, or other substances that may be harmful to trees occurs; restricting storing or <br />operating heavy construction equipment or construction materials shall within the TPZ of any <br />protected tree; among several others protective measures. Implementation Mitigation Measure <br />BIO-4 will reduce the impact to less than significant. This finding is based on the entire record of <br />proceedings for the Project, including but not limited to the discussion and analysis set forth on <br />pages 4.3-33 through 4.3-35 of the DEIR, pages 2-11 and 2-12 of the FEIR, and full statements of <br />the impact and mitigation measure on FEIR pages 4-12 and 4-13, are hereby incorporated herein <br />in its entirety. <br />4.4 Cultural Resources and Tribal Cultural Resources <br />Impact CUL-2: The Project could result in significant impacts to unknown archaeological <br />resources. <br />Mitigation Measures. Mitigation Measure CUL-2 (Inadvertent Discovery of <br />Archaeological Resources or Tribal Cultural Resources) (FEIR p. 4-15) will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact CUL-2: Based on the FEIR and the entire record before the <br />City, the Council finds that Mitigation Measure CUL-2 will reduce the effect of Impact CUL-2, <br />such that the impact would be less than significant. In the event of discovery or recognition of any <br />prehistoric or historic-period resources during construction activities, Mitigation Measure CUL-2 <br />specifies the suspension of work until the San Mateo County Coroner has been contacted to <br />determine that no investigation of the cause of death is required. The Native American Heritage <br />Commission (NAHC) will be contacted within 24 hours if it is determined that the remains are <br />Native American. The NAHC will then identify the person or persons it believes to be the most <br />likely descendant from the deceased Native American, who in turn would make recommendations <br />to the City of Redwood City for the appropriate means of treating the human remains and any grave <br />goods. This finding is based on the entire record of proceedings for the Project, including but not <br />limited to the discussion and analysis set forth on pages 4.4-17 of the DEIR and page 2-12 FEIR, <br />and full statements of the impact and mitigation measure on FEIR page 4.-15, are hereby <br />incorporated herein in its entirety. <br />Impact CUL-3: The Project could directly or indirectly destroy a unique paleontological <br />resource or site or unique geologic feature. <br />Mitigation Measures. Mitigation Measure CUL-3 (Inadvertent Discovery of <br />Paleontological Resources) (FEIR p. 4-15) will be implemented for the Project as provided <br />in the MMRP. <br />Findings Regarding Impact CUL-3: Based on the FEIR and the entire record before the <br />City, the Council finds that Mitigation Measure CUL-3 would substantially lessen the severity of <br />Impact CUL-3, such that this potential impact would be less than significant. Mitigation Measure <br />CUL-3, if paleontological resources are discovered during ground-disturbing activities, work shall <br />stop in that area and within 100 feet of the find until a qualified paleontologist can assess the nature
