Harbor View Project PAGE 1 OF 48 ESA / 170951 <br />Final Environmental Impact Report October 2022 <br />ATTY/RESO.0085/PC RESO RECOMMENDING CEQA – EXHIBIT A <br />REV: 11-02-2022 VR <br />Harbor View Project EIR <br />Findings and Statements Required by the <br />California Environmental Quality Act <br />(Public Resources Code Section 21000 et seq.) <br />I. Introduction <br />On behalf of the City of Redwood City (the “City”), and pursuant to the California <br />Environmental Quality Act (“CEQA”) and Title 14, Chapter 3 of the California Code of <br />Regulations (the “CEQA Guidelines”), the City’s Planning Division has prepared an <br />Environmental Impact Report (the “EIR”) for the Harbor View Project (the “Project”), proposed <br />by Jay Paul Company (“Project Applicant”). The City is the lead agency for the EIR. <br />To support its certification of the EIR and approval of the Project, the City Council of the <br />City of Redwood City makes the following findings of fact and statement of overriding <br />considerations (collectively, the “Findings”). These Findings contain the City Council’s written <br />analysis and conclusion regarding the Project’s environmental effects, mitigation measures, <br />alternatives to the proposed Project, and the overriding considerations which, in the City Council’s <br />view, justify approval of the Project despite its potential environmental effects. These Findings are <br />based upon the entire record of proceedings for the EIR, as described below. <br />II.Overview <br />The City Council initiated the General Plan process on July 24, 2017 for the Project. The <br />City also received from the Project Applicant a City of Redwood City application for <br />Environmental Review and approval of the Project. Pursuant to State CEQA Guidelines Section <br />15063, the City determined that the Project could result in potentially significant environmental <br />impacts and that an EIR would be required. In compliance with Section 21092 of CEQA, the City <br />circulated a Notice of Preparation (“NOP”) of a Draft EIR (the “DEIR”) for the Project to the Office <br />of Planning and Research (OPR) State Clearinghouse and interested agencies and persons on <br />January 12, 2018, for a 30-day review period, January 12, 2018, to February 12, 2018. The NOP <br />solicited comments regarding the scope of the DEIR from identified responsible and trustee <br />agencies, as well as interested parties. <br />The DEIR was published by the City and available for review for a 52-day comment period <br />from January 16, 2019, through March 8, 2019. During the comment period, the interested public <br />and responsible and trustee agencies were invited to submit comments on the DEIR to the City’s <br />Community Development Department. Written and verbal comments on the DEIR were also <br />accepted at a City Council hearing held on February 11, 2019. The DEIR is available on the City’s <br />website (https://www.redwoodcity.org/city-hall/current-projects/development-projects?id=53) and <br />can be reviewed in hard copy at City Hall. <br />Following the completion of the public review period, the City reviewed all comments <br />received on the DEIR and prepared a Final Environmental Impact Report (the “FEIR”). The FEIR, <br />which incorporates by reference the DEIR, includes all comments received during the public review <br />period, responses to those comments, and also describes any changes to the DEIR that resulted
