<br />ATTY/AGR/2022.389/HARBOR VIEW PROJECT DEVELOPMENT AGREEMENT <br />REV: 10-28-2022 VR 4 <br />purposes, the terms, conditions, restrictions, and requirements for subsequent discretionary <br />actions, the provisions of public improvements and financing of public improvements, and other <br />terms and conditions of development as set forth in the General Plan of the City of Redwood City, <br />City’s Municipal Code, City’s Zoning Code, and other City ordinances, rules, regulations, official <br />policies, standards and specifications, all as in force and effect on the Effective Date; and (c) New <br />City Laws that apply to the Property as set forth in Section 5.1, Section 5.2C or Section 5.2D <br />herein; and (d) regulations that apply to the Property as set forth in Section 5.2A and Section 5.2B <br />herein. <br /> “Applicable Law” means (a) all State and Federal laws and regulations applicable <br />to the Property and the Project as enacted, adopted, and amended from time to time; and (b) the <br />Applicable City Regulations. <br />“Area Median Income” or “AMI” means the median income for San Mateo County, <br />California, adjusted for Actual Household Size, as published annually by HCD pursuant to <br />California Health and Safety Code Section 50093(c). <br />“Blomquist Bridge Project Contribution” is defined in Section 3.5C. <br />“Blomquist Water Main Improvements” is defined in Section 6.3E. <br />“Blomquist Water Main Improvements Credit” is defined in Section 6.4A. <br />“CEQA” is defined in Recital D. <br />“Certificate” is defined in Section 7.1D. <br />“Changes in the Law” is defined in Section 5.7. <br />“City” means the City of Redwood City, a California charter city and municipal <br />corporation. <br />“City Parties” means City and its elected and appointed officials, officers, agents, <br />employees, contractors, and representatives. <br />“Claims” means liabilities, obligations, orders, claims, damages, fines, penalties, <br />and expenses, including attorneys’ fees and costs. <br />“Conflict” is defined in Section 5.1. <br />“Connection Fees” means those fees charged by City or by a utility provider to <br />utility users as a cost for connecting to water, sanitary sewer, and other applicable utilities. <br />“Construction Cost Index” or “CCI” means the Engineering News Record (ENR) <br />Construction Co st Index for the San Francisco Urban Area published each year, or if such index <br />is no longer available then a comparable index as reasonably selected by City. <br />“Consumer Price Index” or “CPI” means the San Francisco -Oakland -San Jose
