<br />ATTY/AGR/2022.389/HARBOR VIEW PROJECT DEVELOPMENT AGREEMENT <br />REV: 10-28-2022 VR 5 <br />Consumer Price Index, All Items (1982-84=100) for All Urban Consumers (CPI-U), published by <br />the Bureau of Labor Statistics for the U.S. Department of Labor Consumer Price Index for the San <br />Francisco Bay Area, or if such index is no longer available then a comparable index as reasonably <br />selected by City. <br />“Default” is defined in Section 12.1. <br />“Developer” means Harbor View Property LLC, a Delaware limited liability <br />company and its permitted assignees and successors-in-interest under this Agreement. <br />“Development Agreement Law” is defined in Recital A. <br />“Education Foundation Contribution” is defined in Section 3.4A. <br />“Effective Date” is defined in Section 4.1. <br />“ELI Household” has the meaning set forth in California Health and Safety Code <br />Section 50106. The maximum income for Extremely Low-Income Households shall be as <br />published annually by HCD for San Mateo County. <br />“Enacting Ordinance” is defined in Recital I. <br />“Exactions” means exactions that may be imposed by City as a condition of <br />developing the Project, including requirements for acquisition, dedication, or reservation of land; <br />and obligations to construct on-site or off-site public and private infrastructure improvements such <br />as roadways, utilities, or other improvements necessary to support the Project, whether such <br />exactions constitute subdivision improvements, mitigation measures in connection with <br />environmental review of the Project, or impositions made under Applicable City Regulations. For <br />purposes of this Agreement, Exactions do not include Impact Fees. <br />“Existing Approvals” is defined in Recital E. <br />“Existing Impact Fees” means those Impact Fees o f general applicability within the <br />City that have been adopted by City and are in full force and effect as of the Effective Date, as set <br />forth in Exhibit G. <br />“Extended Term” is defined in Section 4.2B. <br />“Extension Request” is defined in Section 4.2B. <br />“Final Environmental Impact Report” and “FEIR” are defined in Recital D. <br />“First Time Homebuyer Loan Contribution” is defined in Section 3.2B. <br />“Force Majeure Delay” is defined in Section 4.2C. <br />“General Plan” means the General Plan of the City in e ffect as of the Effective <br />Date.
