<br />ATTY/AGR/2022.389/HARBOR VIEW PROJECT DEVELOPMENT AGREEMENT <br />REV: 10-28-2022 VR 6 <br />“HCD” means the California Department of Housing and Community <br />Development. <br />“Household Size Appropriate for the Unit” shall be determined consistent with the <br />California Health and Safety Code Section 50052.5(h), subject to the application of federal rules <br />and regulations applicable to financing sources, including, if applicable, Section 42(g)(2) of the <br />Internal Revenue Code of 1986, as amended. <br />“Housing Impact Fee” means the fee paid under City’s Zoning Ordinance Article <br />29, Section 29.5 by developers of non-residential development projects to mitigate the impacts <br />that such developments have on the demand for affordable housing in the City. <br />“Initial Term” is defined in Section 4.2.A. <br />“Impact Fees” means the monetary fees and impositions, other than taxes and <br />assessments, charged by City in connection with a development project for the purpose of <br />defraying all or a portion of the cost of mitigating the impacts of a development project or <br />development of the public facilities and services related to a development project, including the <br />Housing Impact Fee, Transportation Improvement Impact Fee and any other City “fee” as that <br />term is defined by Government Code Section 66000(b). For purposes of this Agreement, a <br />monetary fee or imposition that meets both the definition of an Impact Fee and the definition of an <br />Exaction will be considered an Impact Fee. <br />“Insubstantial Amendment” is defined in Section 9.2. <br />“Litigation Challenge” is defined in Section 10.5B. <br />“Major Amendment” is defined in Section 9.3. <br />“Maple/Veterans Fair Share Contribution” is defined in Section 6.3B. <br />“MMRP” is defined in Recital D. <br />“Mortgage” is defined in Section 8.1. <br />“Mortgagee” is defined in Section 8.1. <br />“Municipal Code” means the Municipal Code of the City of Redwood City in effect <br />as of the Effective Date. <br />“New City Laws” means and includes any ordinances, resolutions, orders, rules, <br />official policies, standards, specifications, guidelines, or other regulations, which are promulgated <br />or adopted by City (including but not limited to any City agency, body, department, officer or <br />employee) or its or their electorate (through their power of initiative or otherwise) after the <br />Effective Date. <br />“New Impact Fees” means those Impact Fees adopted by City after the Effective <br />Date, if any.
