ATTY/RESO.0096/PC RESO GRANTING APPROVAL OF ARC PERMIT & TENTATIVE PARCEL – 2966 BAY RD – 891 SECOND AVE – 867
SECOND AVE
REV: 11-09-2022 JB
and residential uses. The site is flat, has a frontage along Bay Road and Second
Avenue, and is surrounded by other uses similar in height and intensity, and
properties similar in size.

C. The design or proposed improvements are likely to cause substantial
environmental damage, or substantially and avoidably injure fish, wildlife
or their habitat, or cause serious public health problems.

The combination of three existing parcels into a single parcel would not cause
substantial environmental damage, injure fish or wildlife or their habitat, and
would not cause serious public health problems because the site is located within
an industrial setting surrounded by other developed properties.

The sites are currently developed with an auto service center and restaurant use
with surface parking which would be redeveloped to accommodate the proposed
development.

D. The design or improvements of the proposed subdivision will conflict with
essential public easements for access through, or use of, property within
the proposed subdivision, unless acceptable alternate public easements
will be provided.

The lot combination would not conflict with any essential public easements for
access. The proposed project would not conflict with access of or to any adjacent
properties.

E. Such other findings of conflict with written public policy or with the public
interest as the Subdivision Committee may determine.

The project does not conflict with any written public policy or with the public
interest.

Section 5. Approval Subject to Conditions: The Architectural Permit and Tentative
Map are hereby approved based on the Planning Commission consideration and reliance
on the CEQA Memorandum and in accordance with the attached and referenced plans,
details and descriptions contained therein, attached hereto and incorporated herein by
reference, and subject to the Conditions of Approval as provided in Exhibit A attached to
this resolution.

Section 6. This resolution is effective upon this adoption.

* * *
