BAYSHORE ROAD <br />REV: 12-09-22 VR <br />Page 7 of 61 <br />Findings Regarding Preparation and Consideration of the EIR <br />The Planning Commission finds, with respect to the City’s preparation, review and <br />consideration of the EIR, that: <br /> The City exercised its independent judgment in accordance with Public Resources <br />Code section 20182.1(c) in retaining the independent consulting firm David J <br />Powers & Associates to prepare the EIR, and David J Powers & Associates <br />prepared the EIR under the supervision and at the direction of the City’s Director <br />of Planning and the EIR reflects the City’s independent judgment and analysis. <br /> The City circulated the DEIR for review by responsible and trustee agencies and <br />the public and submitted it to the State Clearinghouse for review and comment by <br />state agencies, as required by CEQA and the CEQA Guidelines. <br /> The EIR and the proposed Project were presented to the City’s Planning <br />Commission, which reviewed and considered, and conducted a public hearing <br />thereon. The Planning Commission determined that the EIR was adequate and <br />sufficient, and prepared in compliance with CEQA and the CEQA Guidelines, and <br />certified the EIR and approve the Project. <br /> The EIR has been completed in compliance with CEQA and the CEQA Guidelines <br />and reflects the City’s independent judgment and analysis. <br />By these Findings, the Planning Commission ratifies, adopts and incorporates the analyses, <br />explanations, findings, responses to comments, and conclusions of the EIR, except as otherwise <br />specifically provided and described in these Findings. <br />IV. Findings Regarding Environmental Impacts. <br /> <br />A detailed analysis of the potential environmental impacts of the Project, and proposed <br />mitigation measures to address all of the identified potentially significant impacts, is set forth in <br />Chapter 4 of the DEIR, as incorporated into the FEIR. The Planning Commission concurs with <br />the conclusions in the DEIR, as incorporated into the FEIR, that changes or alterations have been <br />required, or incorporated into, the Project which avoid or lessen all of the Project’s potentially <br />significant environmental effects to less-than-significant levels. By these Findings, the Planning <br />Commission ratifies and adopts the EIR’s conclusions for all of the following potential <br />environmental impacts, based on the analyses on the referenced pages of the DEIR. <br />A. Findings Regarding No Impact or Less Than Significant Impacts. <br />The following potential environmental impacts of the 557 East Bayshore <br />Project were determined to be less than significant and to not require any mitigation measures, <br />as set forth in Section 3 of the DEIR, as incorporated into the EIR. The Planning Commission <br />concurs with the conclusions in the DEIR, as incorporated into the EIR, and makes the following <br />findings with respect to such less than significant impacts.
