The City’s labor compliance consultant Michael Baker International <br />also reviewed and confirmed Onpoint’s bid submission is compliant with all CDBG requirements outlined <br />in the NIB. <br />Staff recommends approval and authorization for the City Manager to execute an agreement with <br />Onpoint Construction in the amount of $303,125; and authorization for the City Manager or their designee <br />to increase the contract amount, if necessary, up to 10% of the amount awarded in an amount not to <br />exceed $30,312 for a total amount of $333,437. <br />FISCAL IMPACT <br />The total bid price of $303,125 will be funded using CDBG dollars and funds from the FOCC Facilities <br />Upgrade and Improvements Program Account within the Capital Outlay Fund. Any contingency funding <br />needs will be drawn from the City’s Tenant Improvement Program Account of the Capital Outlay Fund. <br />Staff will be requesting mid-year budget amendments to transfer the recently approved additional <br />funding into the appropriate accounts. <br />ENVIRONMENTAL REVIEW <br />This project meets the CEQA exemption criteria as set forth in CEQA Guidelines Section 15301 (Class 1 – <br />Existing Facilities) in that it involves the minor alteration of existing City Facilities with negligible or no <br />expansion of an existing use. <br />Under the National Environmental Protection Act (NEPA), this project has been determined to be <br />converted to exempt, per §58.34(a)(12) because there are no circumstances which require compliance <br />with any of the federal laws and authorities cited at §58.5. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />Commented [MG1]: @Theresa Yee: Please confirm <br />funding. <br />Commented [TY2R2]: Program 83176 has $105,277 <br />available in Fund 256 and $111,443 in Fund 357 on 8/14/24. <br />The mid-Year amendment should be at least $87k.
