27 <br />Members authorized BAWSCA to make a prepayment of the Capital Cost Recovery Payments <br />on their behalf (the “Prepayment”). <br />In 2013, BAWSCA issued its Bay Area Water Supply and Conservation Agency Revenue <br />Bonds (Capital Cost Recovery Prepayment Program), Series 2013A (the “2013A BAWSCA <br />Bonds”), in the aggregate principal amount of $241,475,000, and its Bay Area Water Supply and <br />Conservation Agency Revenue Bonds (Capital Cost Recovery Prepayment Program), Series <br />2013B (Taxable) (the “2013B BAWSCA Bonds” and, with the 2013A BAWSCA Bonds, the “2013 <br />BAWSCA Bonds”). The 2013A BAWSCA Bonds were refunded in January, 2023 by BAWSCA’s <br />Bay Area Water Supply and Conservation Agency Refunding Revenue Refunding Bonds, Series <br />2023A, in the aggregate principal amount of $134,310,000 (the “2023A BAWSCA Bonds” and, <br />with the 2013B BAWSCA Bonds, the “BAWSCA Bonds”). <br />To provide for payment of the BAWSCA Bonds, BAWSCA imposes surcharges on water <br />sold to the Members (the “BAWSCA Surcharge”). Each Member is charged a fixed amount <br />based upon such member’s share of water delivered by the SFPUC in the Fiscal Year prior to the <br />one in which such charge is calculated. Each Member’s payment obligation is expected to be <br />adjusted in subsequent Fiscal Years to reflect such Member’s actual share of water deliveries in <br />the current Fiscal Year. The BAWSCA Surcharge is billed and collected for BAWSCA by the <br />SFPUC together with amounts billed by the SFPUC for water deliveries under the WSA. The <br />City’s annual BAWSCA Surcharge for Fiscal Year 2024-25 is $1,279,584. <br />Drought Measures <br />General. The drought in California from 2020 to 2022 was the driest three-year period on <br />record. Following the second driest year on record and with near record low storage in California’s <br />largest reservoirs, Governor Newsom declared a statewide drought emergency in October 2021 <br />and called for voluntary statewide water use reductions of 15% compared to 2020 water use. <br />Heavy rain in early 2023 significantly helped drought conditions and, on March 24, 2023, <br />Governor Newsom ended the 15% water conservation target and requirement for water agencies <br />to implement level 2 of their drought contingency plans. However, it is likely that drought <br />conditions will reappear in the future. <br />Water Shortage Contingency Plan. The City has adopted a Water Shortage <br />Contingency Plan (“WSCP”) that lays out various methods for mitigating the effects of water <br />shortages of increasing intensity in six stages. The WSCP includes voluntary and mandatory <br />water use restrictions designed to reduce flexible water use depending on the cause, severity, <br />and anticipated duration of the supply shortage. The WSCP details the protocols and procedures <br />that the City will implement at each stage of a declared water shortage to help water users comply <br />with the shortage response actions. <br />City Response to Drought. The City has a long-standing water conservation program <br />that includes offering water saving rebates, public training courses, efficient fixture giveaways, <br />and home water audits to its customers. In addition, the City maintains certain prohibitions, such <br />as the application of potable water to driveways and sidewalks, the application of potable water <br />to outdoor landscapes during and within 48 hours after measurable rainfall, and the application of <br />potable water to outdoor landscape in a manner that causes runoff. <br />8.A. - Page 41 of 255 <br />669
