Because they lack oversight, unacceptable conditions in restaurant trash areas are likely not to be <br />rectified. <br />Proposed Response: The City agrees with the finding. <br />F6. Waste water from the cleaning of trash areas and from rain flow into the storm drain systems. <br />Proposed Response: The City disagrees partially with the finding. While the City agrees with the finding as <br />it relates to older trash areas, it notes that trash areas within newer and substantially remodeled <br />developments are required to be plumbed to the sewer utility and meet stormwater permitting <br />requirements, which significantly reduces the wastewater flow into storm drains. <br />For recommendations in the Grand Jury’s report, the City is to respond using one of the following actions: <br />1. The recommendation has been implemented, with a summary regarding the implemented action. <br />2. The recommendation has not yet been implemented, but will be implemented in the future, with a <br />time frame for implementation. <br />3. The recommendation requires further analysis, with an explanation and the scope and parameters of <br />an analysis or study, and a time frame for the matter to be prepared for discussion by the officer or <br />director of the agency or department being investigated or reviewed, including the governing body of the <br />public agency when applicable. This time frame shall not exceed six months from the date of publication <br />of the Grand Jury report. <br />4. The recommendation will not be implemented because it is not warranted or reasonable, with an <br />explanation, therefore. <br />Recommendation and Proposed City Response: <br />R4. By June 30, 2025, inspectors for all jurisdictions with restaurants should be empowered to require <br />owners/operators to add receptacles or increase the frequency of pick-ups. <br />Proposed Response: The Health Officer or other duly authorized representative [City Code Enforcement <br />Officer] is authorized to conduct sanitary inspections under Chapter 14, Article 1, Section 14.3 – Sanitary <br />Inspections and ensure compliance with Chapter 14, Article II, Section 14.11 – Duty to Provide; Size, <br />Qualities and Number Required and Section 14.13 – Duty to Keep Sanitary. <br />6.F. - Page 3 of 32 <br />47
