Changes to state and federal laws thus often require changes to the City’s local Code. For <br />example, the California State Legislature, through a number of Senate and Assembly Bills and <br />amendments to the Subdivision Map Act, made changes to regulations to streamline housing <br />development projects. Some of these changes conflict with the City’s local Code and, therefore, <br />amendments to the City Code are necessary to comply. <br />City Code Chapters 18 (Local Improvements and Planning), 27A (Stormwater Management and Discharge <br />Control Program), and 30 (Subdivisions) have not undergone major updates since 1998, 1995, and 1979, <br />respectively. To address changes in law as well as to update these chapters to reflect preferred practices <br />and procedures, the below chapters are generally proposed to be amended or superseded (please see a <br />more detailed overview of the amendments in the Analysis section below): <br />Chapter 18, Local Improvements and Planning <br />The amendments to this Chapter identify improvement requirements that are applicable when <br />development occurs, including when constructing a new building and remodeling an existing building. <br />Chapter 27A, Stormwater Management and Discharge Control Program <br />The amendments to this Chapter clearly identify the types of development projects, including tenant <br />improvements of existing space that must comply with stormwater requirements. The proposed <br />amendments maintain the goal is to ensure stormwater quality is as natural and as free from <br />contaminants as possible. The associated resolution updates the Green Infrastructure Development <br />Standards for substantial commercial remodel threshold from more than 10,000 square feet to 25,000 <br />square feet or more. <br />Chapter 30, Subdivisions <br />This Chapter regulates subdivision mapping, property, and boundary line-related applications. This <br />Chapter contains the procedures and requirements for subdivisions, mergers, reconfigurations of <br />land, and certificates of compliance confirming legality of existing lots within the City. Much of this <br />Chapter is outdated due to changes in state law, so it is necessary to repeal and replace the Chapter <br />in its entirety to bring it up to date. <br />With the advent of changing state and federal regulations in recent years, including changes to the State <br />Subdivision Map Act, as well as the various housing and permit streamlining bills, it is the appropriate time <br />for these chapters of the Municipal Code to be updated to comply with the current federal and state <br />regulations, reflect current practices and processes, enhance streamlining of permits, and introduce <br />greater flexibility for housing applicants to comply with applicable requirements. <br />8.A. - Page 2 of 88 <br />246
