<br />11 <br /> <br /> <br />7.3.2 In the event of an employee absence, to avoid putting an apparatus <br />out of service, the department may temporarily reduce staffing to <br />three (3) people per apparatus while relief staff is being hired. <br /> <br />7.3.3 The regular work schedule for employees in the classification of <br />Deputy Fire Marshal and Fire Prevention Officer shall be forty (40) <br />hours in a seven (7) day work week (typically five [5] consecutive <br />eight [8] hour days), with the option of working an alternative work <br />schedule based on the operating needs of the department. The work <br />schedule is subject to approval by the Fire Chief and can be changed at <br />any time. <br /> <br />Employees in the classifications of Deputy Fire Marshal and Fire <br />Prevention Officer may be assigned to work an alternative work <br />schedule referred to as a “9/80 schedule” at the sole discretion of <br />management. Employees assigned to a 9/80 schedule are scheduled <br />to work eight (8) nine-hour days and one (1) alternating eight-hour <br />day every two (2) weeks, totaling eighty (80) scheduled work hours <br />over nine (9) shifts per two-week period. <br /> <br />For purposes of FLSA overtime, the workweek applicable to <br />employees on a 9/80 schedule begins four (4) hours into their <br />alternating eight-hour day and ends one hundred sixty-eight (168) <br />consecutive hours later. Employees on a 9/80 schedule are not <br />permitted to flex their alternating eight-hour day off or flex their <br />hours on their alternating eight-hour work day. Employees on a 9/80 <br />schedule are not permitted to work hours outside their schedule <br />without prior approval. <br /> <br />7.4 Starting Time <br /> <br />The regular starting time for Fire Fighter/Engineers and Fire Captains scheduled <br />for a fifty-six (56) hour workweek shall be 8:00 A.M. <br /> <br />7.5 Overtime <br /> <br />7.5.1 Fifty-six (56) Hour Workweek Employees <br /> <br />For the purposes of this MOU, overtime for employees in the <br />classifications of Fire Fighter/Engineer and Fire Captain is authorized <br />time worked beyond the employee’s regularly scheduled hours in <br />Section 7.3. Overtime shall be compensated at one and one-half <br />(1.5) times the employee's regular rate of pay for any time worked <br />6.A. - Page 22 of 99 <br />29
