<br />12 <br /> <br />beyond a Fire Fighter/Engineer or Fire Captain’s regular twenty-four <br />(24) hour work shift. For the purposes of this MOU, the regular rate <br />of pay shall be defined as the employee’s base hourly rate of pay <br />based on a 56-hour work week (112 hours per pay period), and <br />including incentives or other forms of pay (paramedic pay, special <br />equipment operator (fire boat pilot) incentive, training captain pay, <br />educational incentive, EMT incentive, bilingual differential, holiday <br />compensation). Overtime must be authorized by the Fire Chief, or <br />designated representative, prior to such overtime being worked. <br /> <br />For the purposes of calculating overtime under the Fair Labor <br />Standards Act (“FLSA”), the City has adopted a twenty-four (24)-day <br />work period, pursuant to 29 U.S.C. § 207(k), to which Shift Employees <br />are subject. <br /> <br /> 7.5.2 Compensatory Time <br /> <br />Upon request, employees shall be compensated for overtime in <br />compensatory time off. An employee’s compensatory time off (CTO) <br />balance shall not exceed seventy-two (72) hours at any given time. <br />Effective as soon as administratively feasible following the City <br />employing twenty-seven (27) stand-alone Firefighter/Engineer <br />Paramedics, an employee will not earn more than one hundred sixty- <br />eight (168) hours of compensatory time off (CTO) in a calendar year <br />(“hard cap”). <br /> <br />Between such time and June 30, 2026, if Department staffing falls to <br />twenty-three (23) or fewer stand-alone Firefighter/Engineer <br />Paramedics for three (3) months or longer, the CTO cap will <br />temporarily become a 168 hour “soft cap” whereby an employee’s <br />CTO balance shall not exceed 168 hours at any given time, until the <br />City returns to twenty-four (24) or more stand-alone <br />Firefighter/Engineer Paramedics. This provision expires June 30, <br />2026, at which time the City will revert to the hard cap of 168 hours <br />of CTO (maximum of 168 hours of CTO accrued per calendar year). <br /> <br />CTO shall not be earned for work performed that is reimbursable by <br />the State or Federal government, including backfilling for employees <br />on strike teams. <br /> <br />7.5.3 Forty (40) Hour Workweek Employees <br /> <br />For the purposes of this MOU, overtime for employees in the <br />classification of Deputy Fire Marshal and Fire Prevention Officer is <br />6.A. - Page 23 of 99 <br />30
