<br />29 <br /> <br />8.6 Holiday In Lieu Compensation for Fifty-Six (56) Hour Work Week Fire <br />Fighter/Engineer and Fire Captain <br /> <br />Each employee in the classifications of Fire Fighter/Engineer and Fire Captain <br />assigned to a fifty-six (56) hour work week shall be exempt from the provisions <br />of Sections 8.1, 8.2, 8.3, 8.4 and 8.5 above, and shall receive no additional <br />compensation in the form of pay or time off in the event the employee is <br />required to work on any of the days set forth in Section 8.1. <br /> <br />In lieu of any holiday benefits, each employee shall receive compensation in the <br />amount of 8.65% of base salary payable on a bi-weekly basis. <br /> <br />Fire Fighter/Engineers and Fire Captains who are in a no-pay status (e.g. on leave <br />of absence or family medical leave) will receive holiday compensation on a pro- <br />rated basis. <br /> <br />Fire Fighter/Engineers and Fire Captains temporarily assigned to a forty (40) <br />hour work week shall continue to receive the Holiday in-lieu compensation <br />instead of holiday time off. Employees who are required to or request time off <br />on a holiday shall be required to use paid leave in accordance with City policies. <br /> <br />Subject to approval of the Fire Chief, employees assigned to a forty (40) hour <br />work week schedule may work on a designated holiday and receive holiday <br />compensation for that time period consistent with those assigned to a fifty-six <br />(56) hour workweek schedule. Such employees shall be exempt from “Feast <br />Day” provisions and practices, and shall receive no additional compensation in <br />the form of pay or time off in the event the employee is required to work on any <br />of these days set forth in Section 8.1. Under no circumstances will such <br />employees simultaneously receive paid holiday time off and holiday pay. <br /> <br />SECTION 9 - VACATIONS <br /> <br />9.1 All regular full-time employees shall be entitled to accrue vacation leave from <br />the commencement of their employment with the City. <br /> <br />The times during the calendar year at which an employee shall take vacation <br />shall be approved by the Fire Chief, or designated representative, with due <br />regard to the wishes of the employee and particular regard to the need of the <br />service. Each November, employees shall, on a form provided by the City, <br />indicate their preference for vacation periods within the upcoming calendar <br />year, in accordance with Section 9.6 of this MOU.
