<br />32 <br /> <br />advance for leave, or one-hundred twenty (120) hours in advance for <br />cancellations, will be approved only at the discretion of the Battalion Chief. <br /> <br />No more than five (5) employees per shift, irrespective of rank, may be on <br />vacation leave at the same time. Upon request, the Fire Chief or their designee <br />may permit a sixth (6th) person per shift to be on vacation at a given time. <br /> <br />During annual vacation picks and thereafter, if applicable, Fire Captains and Fire <br />Fighter/Engineers may select the following Holidays: Thanksgiving, Christmas <br />Eve, and Christmas. However, the employee(s) requesting the respective <br />Holiday leave may be required to find their own relief depending on relief <br />staffing available. The employee requesting the respective Holiday leave may <br />also utilize individuals on the existing OT sign up list in the automated scheduling <br />software to secure relief. The required paperwork must be submitted at least <br />48 hours prior to the requested leave or the leave will not be approved. The <br />relief person(s) will be paid the appropriate overtime, with approval. <br /> <br />The Scheduling Guide and the Lexipol Manual cover Personnel Time Off and <br />includes all rules pertaining to leave selection. Changes to the Scheduling Guide <br />will only be made with mutual agreement between the Fire Chief and the <br />Association utilizing an agreed upon procedure. <br /> <br />As of the signing of the 2021 MOU, the Staffing Guide rules were as follows: <br /> <br />Employees assigned to fifty-six-hour workweek schedule will accrue <br />one (1) break protection for every twenty-four (24) hours of vacation <br />accrued. Use of a break protection protects the employee from <br />mandatory overtime for a ninety-six (96) hour period between regular <br />shifts. The Fire Chief may override an employee’s break protection in <br />the event of a natural disaster, infectious disease outbreak, or other <br />critical staffing situation. <br /> <br />When making a vacation selection during annual vacation bidding, an <br />employee can pick vacation days and break protection(s) previous to, <br />and/or following the vacation days in order to secure the consecutive <br />days off. After vacation bidding is complete, break protections may be <br />used on a first come, first served basis. Break protections will be <br />entered into the automated scheduling software program prior to <br />hiring. The Scheduling Guide will provide rules related to break <br />protections. At the end of the calendar year, unused break protections <br />shall be lost, and cannot be rolled over to the next calendar year. <br /> <br />6.A. - Page 43 of 99 <br />50
