<br />33 <br /> <br />All other break protection rules will be eliminated, including the <br />provision of automatic break protection when an employee takes <br />vacation or CTO on day two of their shift. <br /> <br />Individuals identified by the Department will track accrual waitlists and <br />use of vacation picks and break protections. This tracking system is <br />stored on the Department shared drive and in a back up to the <br />automated tracking software. <br /> <br />For the Deputy Fire Marshal and Fire Prevention Officers, vacation <br />scheduling will occur in accordance with applicable Department hiring <br />rules found in the Scheduling Guide. <br /> <br />9.7 Illness During Vacation <br /> <br />9.7.1 An employee who commences a scheduled vacation period and <br />subsequently becomes ill before their vacation period has been <br />completed shall be placed on sick leave under the following conditions: <br /> <br />9.7.1.1 The employee otherwise has the requisite amount of accrued, <br />unused sick leave and otherwise qualifies for sick leave as <br />provided by this Agreement; and <br /> <br />9.7.1.2 The employee, if no longer ill, returns to duty immediately <br />following the vacation period; and, <br /> <br />9.7.1.3 The employee's illness is verified by a statement from a licensed <br />medical practitioner for each such day of sick leave requested. <br /> <br />9.7.1.4 When the employee's vacation leave is to be converted to sick <br />leave, the appropriate vacation credit shall be restored to the <br />employee’s earned vacation balance, and a reasonable <br />opportunity to utilize this vacation credit shall be provided <br />within the City's existing practices. <br /> <br />9.8 Effective January 1, 2022, use and cash out of vacation will be calculated by <br />rounding to two (2) decimal places rather than three (3) decimal places (i.e., .XX <br />instead of .XXX). <br /> <br />9.9 Annual Vacation Cash Out <br /> <br />An employee may elect to receive compensation in lieu of a portion of accrued <br />and unused vacation leave credits for any calendar year (based on the first <br />twenty-six (26) pay periods ending that year) by requesting payment of unused <br />6.A. - Page 44 of 99 <br />51
