<br />38 <br /> <br />Eligible lists shall continue in effect one (1) year after establishment. They may <br />be extended for a period not to exceed one (1) year or abolished before the <br />expiration of the yearly period by the Personnel Officer upon recommendation <br />of the Fire Chief. <br /> <br />13.5 Removal from Eligible List <br /> <br />The name of any person on an eligible list may be removed by the Personnel <br />Officer if the eligible person requests in writing that their name be removed, if <br />the person fails to respond to a written offer of employment within five (5) days <br />or receipt of the mailing of a notice, if a subsequent report of a character <br />investigation is unsatisfactory, or the person has been rejected for appointment <br />three (3) times by the Fire Chief. <br /> <br />13.6 Time Off for Examination <br /> <br />Promotional examinations scheduled by the City during an employee's regular <br />working hours may be taken without any loss in compensation. <br /> <br />SECTION 14 - DISCIPLINE <br /> <br />14.1 Right of Discipline <br /> <br />The City shall have the right to discipline any employee for just cause. <br /> <br />14.2 Disciplinary Procedures <br /> <br />14.2.1 Response to Adverse Comments <br /> <br />An employee will have thirty (30) days within which to file a written response to <br />any adverse comment entered into their personnel file, which does not <br />constitute a punitive action as described below. The written response will be <br />attached to the adverse comment. <br /> <br />14.2.2 Appeal Procedure for Punitive Action Other Than Suspension, <br />Reduction in Pay, Demotion or Discharge <br /> <br />The following informal procedure will apply to employees (as defined by <br />Government Code Section 3251) as to letters of reprimand, disciplinary transfers <br />or non-voluntary, non-disciplinary transfers resulting in a loss of compensation <br />(e.g., non-disciplinary transfer out of premium pay assignment).
