<br />43 <br /> <br />If an employee feels they have been unjustly disciplined, they shall have the right <br />to appeal their case through the grievance procedure. Such appeals must be <br />filed in writing by the Association within ten (10) work days from date of <br />discipline; and unless so filed, the right of appeal is lost. "Work" days as used in <br />this section shall be defined as any day when the Administrative Offices of the <br />City are open for public business. <br /> <br />Any disciplined employee shall be furnished the reason for discipline in writing. <br /> <br />14.4 Probationary Employees <br /> <br />Probationary employees may be discharged for any reason which, in the sole <br />opinion of the City, is just and sufficient and such discharge shall not be subject <br />to the disciplinary appeal or grievance procedure. <br /> <br />SECTION 15 – RESIGNATION AND REINSTATEMENT <br /> <br />15.1 Resignation <br /> <br />An employee wishing to leave the service in good standing shall file with the Fire <br />Chief a notice of intention to leave the service no less than fourteen (14) calendar <br />days in advance. The written resignation shall state the effective date. The <br />resignation shall be forwarded to the Human Resources Department with a <br />statement by the Fire Chief as to the resigned employee's service performance <br />and other pertinent information concerning the cause of resignation. <br /> <br />15.2 Reinstatement <br /> <br />At the discretion of the Fire Chief and Personnel Officer, a regular employee who <br />has resigned in good standing may be reinstated to a vacant position of the same <br />class at their previous position within a period of one (1) year from the effective <br />date of the employee’s resignation. Reinstatement shall be made at the salary <br />step recommended by the Fire Chief and approved by the Personnel Officer, no <br />lower than the salary step held at the time the employee left City employment. <br /> <br />A regular employee who is reinstated within thirty (30) working days of leaving <br />City employment shall be reinstated as if they had been on an unpaid leave of <br />absence. Any benefits which were cashed out shall be reinstated if the employee <br />elects to buy back such benefits, subject to the restrictions of the Public <br />Employees’ Pension Reform Act. <br /> <br />The reinstated employee will serve the designated probationary period for that <br />classification prior to becoming a regular employee, regardless of the salary step <br />at which the employee was reinstated. <br />6.A. - Page 54 of 99 <br />61
