ATTY/ORD.0010/CC ORD AMENDING MUNI CODE CH.18, 27A, 30 – EXHIBIT A <br />REV: 09-17-24 VR <br />Page 1 of 2 <br />EXHIBIT A – CHAPTER 18 AMENDMENTS <br /> <br />Sec. 18.235. - DEFINITIONS: <br /> <br />NEW BUILDING(S) (Residential or Commercial): Means any construction of a building, or <br />buildings with a total floor area of eight hundred (800) one thousand (1,000) square feet or <br />more. New residential buildings also include any construction resulting in modification of <br />fifty percent (50%) or more of the structural walls of an existing residential building. <br /> <br />*** <br />SUBSTANTIAL COMMERCIAL REMODELING or SUBSTANTIAL REMODELING OF A <br />COMMERCIAL BUILDING: Means any: (A) remodeling of a commercial building or buildings <br />and/or the construction of tenant improvements which amounts to more than fifty percent <br />(50%) of the square footage of the existing building or building(s) on which the remodeling <br />or the tenant improvements are performed; or (B) the construction of an addition of one <br />thousand (1,000) square feet or more floor area to a commercial building; or (C) a <br />combination of remodeling, tenant improvements, and construction of an addition if the <br />combined square footage of any improvement amounts to fifty percent (50%) or more of <br />the square footage of the existing commercial building. <br /> <br />*** <br />Sec. 18.242. - UNDERGROUND UTILITIES: <br /> <br />A. Upon the construction of a any new commercial or residential building of four units or <br />more, the electrical, telephone and cable TV lines will be installed underground along the <br />street frontage as well as on the subject property. In lieu of the underground requirements <br />along the street frontage associated with the construction of a new commercial or <br />residential building of four units or more, or a minor subdivision with four or fewer lots, a <br />developer may pay a fee, as established by resolution of the City Council, into the City’s <br />Utility Undergrounding Fund. Said fee will not exceed the costs associated with the <br />required undergrounding. <br /> <br />B. Upon the construction of any new residential building (three units or less), the overhead <br />services servicing the building shall be undergrounded. This may require design, permitting, <br />and construction outside of the property boundary. In lieu of the underground requirements <br />for the overhead services associated with the construction of a new residential building, a <br />developer may pay a fee, as established by resolution of the City Council, into the City's <br />Utility Undergrounding Fund. Said fee will not exceed the costs associated with the required <br />undergrounding. The City Engineer shall have the discretion to grant hardship exception to <br />this requirement based on the following factors, including but not limited to: whether there <br />is sufficient rights/interest/title for the undergrounding, location of the nearest pole(s), and <br />location of existing improvement(s) along proposed route of underground conduits
