City staff negotiated the final scope <br />of work and budget, which is included in Attachment 1 (Agreement for Services). The scope of work <br />includes development of the 100% PS&E, the project’s pre- and post-evaluation, construction engineering <br />support, design services during installation, and neighborhood outreach support. <br />FISCAL IMPACT <br />The contract amount is included in the FY 2024-25 Capital Improvement Program Budget. The total cost <br />of design phase is funded by OBAG3 grant ($280,000) and a local match ($99,305) that is covered by <br />Measure A Fund 262 Traffic Safety Program, which has an available budget balance of $2,325,084 as of <br />August 26, 2024. No General Fund resources are required. <br />ENVIRONMENTAL REVIEW <br />This action is not a project under the California Environmental Quality Act (CEQA) because entering into <br />this agreement has no potential for resulting in either a direct or reasonably foreseeable indirect physical <br />change in the environment. Future construction of the project will be categorically exempt from the <br />requirements of CEQA pursuant to CEQA Guidelines Section 15301(c), Class 1 (“Existing Facilities”) for the <br />repair and maintenance of existing highways and streets with negligible or no expansion of an existing <br />use. <br />As it is required for the federally funded projects, this project is subject to the National Environmental <br />Policy Act (NEPA). NEPA documents will be prepared and submitted to Caltrans at the 65% design stage. <br />The contract scope includes technical assistance for NEPA processing. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may direct staff to modify elements of the agreement and to renegotiate with the <br />consultant. <br />ATTACHMENTS <br />Attachment A – Agreement for Services with Kimley-Horn <br />6.B. - Page 3 of 46 <br />28
