Findings and Statements Required by the California Environmental Quality Act <br />Focused General Plan Update 18 <br />Final Environmental Impact Report January 2023 <br />The San Francisco Bay Basin Water Quality Control Plan (Basin Plan) is the water quality <br />control plan for the San Francisco Bay Region, including the Planning Area, and it designates <br />beneficial uses, establishes water quality objectives, and contains implementation programs and <br />policies to achieve those objectives for all waters addressed through the Basin Plan. The Basin Plan <br />is continually being updated to include amendments related to implementation of the TMDL of <br />specific potential pollutants or water quality stressors, revisions of programs and policies within <br />the San Francisco Bay RWQCB region, and changes to beneficial use designations and associated <br />water quality objectives. <br />The General Plan requires future development within the Planning Area to be consistent <br />with NPDES permit requirements, and because the Basin Plan is the master water quality control <br />planning document for the RWQCB, the Project would therefore not conflict with or obstruct <br />implementation of a water quality control plan. In addition, the City overlies the southern end of <br />the San Mateo Plain Subbasin of the Santa Clara Valley Basin, however, the subbasin is not <br />adjudicated, and DWR has not determined that the subbasin is in a condition of overdraft. The <br />subbasin is identified as a “very low priority” basin by DWR, and therefore not subject to the <br />requirements of SGMA. The Project would not conflict with or obstruct implementation of a <br />sustainable groundwater management plan, and this impact would be less than significant. Land Use and Planning <br />Impact LAND-1: The proposed Project would not physically divide an established <br />community. <br />The proposed Project does not include major circulation or infrastructure changes that <br />would restrict access to any particular areas of the City or otherwise would include policies that <br />would limit or preclude access between adjacent areas or neighborhoods within a city. Therefore, <br />the potential impact would be considered less than significant. (Draft EIR, pp. 4.11-14 to 4.11-15) <br />Impact LAND-2: The proposed Project would not cause a significant environmental impact <br />due to a conflict with any land use plan, policy, or regulations adopted for the purpose of <br />avoiding or mitigating an environmental effect. <br />The proposed Project includes Housing Element Update, Safety Element Update, and <br />Environmental Justice goals, policies, and programs that would be adopted as part of the General <br />Plan and, consequently, would be generally considered consistent with those General Plan policies. <br />The updated elements would comply with applicable State Planning Law requirements for these <br />general plan elements, and the proposed housing sites identified within the Housing Element <br />Update would allow the City to meet its RHNA as identified by ABAG. Several zoning <br />amendments are proposed to allow for an increase in residential development within the Planning <br />Area and include rezoning a commercial office zoning district to mixed-use; increasing allowable <br />densities and standalone residential building heights in mixed-use zoning districts; and making <br />changes to development standards within the R-2 through R-5 zoning districts to allow for more <br />housing development. Future development facilitated by the Project would be required to be <br />consistent with the amended General Plan and zoning designations, as well as applicable <br />development standards.
