Findings and Statements Required by the California Environmental Quality Act <br />Focused General Plan Update 38 <br />Final Environmental Impact Report January 2023 <br />remains are encountered during ground-disturbing activities within specific project sites, <br />work within 50 feet shall be stopped and the San Mateo County Coroner notified of any <br />human remains; at the same time, a qualified archaeologist shall be contacted to assess the <br />situation and consult with the appropriate agencies; and if the human remains are of Native <br />American origin, the Coroner shall notify the NAHC so that NAHC can identify a Most <br />Likely Descendant (MLD) to inspect the site and provide recommendations for the proper <br />treatment or disposition, with proper dignity, of the remains and any associated grave <br />goods. Mitigation Measure CUL-3b requires all construction crews undergo a training <br />session prior to issuance of grading permits to inform them of the presence and nature of <br />federal or state-eligible cultural resources and the potential for previously undiscovered <br />archaeological resources and human remains within specific project sites, of the laws <br />protecting these resources and associated penalties, and of the procedures to follow should <br />they discover cultural resources during project-related work. <br />4.13. Noise <br />Impact NOISE-3: The proposed Project would not result in generation of excessive ground- <br />borne noise levels. <br />Mitigation Measures. EIR Mitigation Measure NOISE-1 (Draft EIR p. 4.13-43) will be <br />implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact NOISE-3: Based on the FEIR and the entire record before <br />the City, the Council finds that incorporating the requirements of Mitigation Measure <br />NOISE-1 would substantially lessen the severity of Impact NOISE-3, such that this <br />potential impact would be less than significant. Mitigation Measure NOISE-1 requires that <br />require new residential projects located within 200 feet of the railroad track and <br />commercial projects located within 120 feet conduct a train ground vibration and vibration <br />noise evaluation consistent with approved vibration assessment methodologies (e.g., <br />Caltrans, Federal Transportation Authority). <br />4.17. Transportation <br />Impact TR-2: The proposed Project would conflict or be inconsistent with CEQA Guidelines <br />section 15064.3(b). <br />Mitigation Measures. EIR Mitigation Measures TR-1 and TR-2 (Draft EIR p. 4.17-41) <br />will be implemented for the Project as provided in the MMRP. <br />Findings Regarding Impact TR-2: Based on the FEIR and the entire record before the <br />City, the Council finds that incorporating the requirements of Mitigation Measures TR-1 <br />and TR-2 into the Project would substantially lessen the severity of Impact TR-2. <br />Mitigation Measure TR-1 would require all future residential development projects that do <br />not meet the City’s VMT screening criteria and exceed the City’s home-based residential <br />VMT threshold to develop a TDM Plan and quantify the VMT effectiveness of the plan.
