ATTY/RESO.0070/CC RESO 1900 BROADWAY (CEQA) <br />REV: 10-23-24 VR <br />Page 2 of 5 <br />Plan to ensure consistency between the DTPP and the General Plan; and <br /> <br />WHEREAS, on June 26, 2023, the City Council adopted Resolution Nos. 16154 <br />and 16155, and approved the General Plan Mixed Use Downtown and the DTPP Plan- <br />Wide Amendments that evaluated the potential for new office development up to <br />1,167,100 sq. ft. in the DTPP area (including the redevelopment of 1900 Broadway) and <br />included a process change requiring City Council approval for any DTPP Large Project <br />requesting General Plan Amendments and that such projects would also negotiate a <br />Development Agreement; and <br /> <br />WHEREAS, the Project would create office space within the downtown and <br />General Plan and DTPP Amendments are required by the DTPP to increase the <br />Maximum Allows Development office capacity currently allowed in the General Plan and <br />DTPP; and <br /> <br />WHEREAS, the planning application for the Project seeks approval of: 1) a <br />General Plan Amendment and a DTPP Amendment (GP2021-007) to adjust the <br />maximum development caps for office use; 2) a Vesting Tentative Parcel Map (TM2021- <br />13) to combine lots and adjust lot lines for Project site assembly; 3) a Downtown Planned <br />Community Permit (DPC 2021-010) to construct a mixed use commercial office project <br />and a Use Permit (UP 2021-020) to allow General Retail and Public Open Space uses, <br />all subject to Conditions of Approval for the Project; 4) an Affordable Housing Plan with <br />associated documentation and agreements; and, 5) approval of a Development <br />Agreement negotiated between Applicant and the City; and <br /> <br />WHEREAS, the Applicant and the City have negotiated a Development <br />Agreement, which includes the Applicant’s voluntarily offered community benefits that <br />exceed the standard development requirements as specified in the Community Benefits <br />Analysis by Strategic Economics, and which shall be concurrently considered herein with <br />the General Plan and DTPP Amendments, land use permits, and affordable housing plan <br />(“Development Agreement Ordinance”); and <br /> <br />WHEREAS, the DTPP SEIR programmatically evaluated the potential for <br />additional office and residential development in the DTPP area to accommodate the <br />Gatekeeper Projects (one of which was 1900 Broadway) and additional development <br />potential in the DTPP, resulting in an additional office development of 1,167,100 square <br />feet; and <br /> <br />WHEREAS, CEQA Guidelines Section 15183 provides for streamlined <br />environmental review for Projects that are consistent with the development density <br />established by existing zoning, community plan or General Plan Policies for which an <br />Environmental Impact Report (EIR) was certified, except as might be necessary to <br />examine whether there are Project-specific significant effects which are peculiar to the <br />project or its site; and <br /> <br />
