<br />WHEREAS, CEQA Guidelines Section 15183 specifies that when reviewing a
<br />project that meets the requirements of this section, a public agency shall limit its
<br />examination of environmental effects to those that the agency determines in an
<br />environmental checklist or other analysis; and
<br />
<br />WHEREAS, a CEQA Guidelines Section 15183 Consistency Checklist, dated
<br />September 13, 2024 (“CEQA Consistency Checklist”), attached as Exhibit 1 and
<br />incorporated herein, was prepared by the City’s Planning Division, which provides
<br />substantial evidence that the Project is within the scope of the DTPP EIR and DTPP SEIR;
<br />and
<br />WHEREAS, on September 17, 2024, the Planning Commission conducted a duly
<br />noticed public hearing, in accordance with all applicable requirements of the State
<br />Planning and Zoning Law, the Redwood City Code, and the Redwood City Zoning
<br />Ordinance, to review and recommend to the City Council the CEQA Consistency
<br />Checklist and associated Project approvals; and
<br />
<br />WHEREAS, after the public hearing, the Planning Commission considered the
<br />staff report and the application materials, including without limitation the DTPP EIR, DTPP
<br />SEIR, CEQA Consistency Checklist, General Plan Amendment, DTPP Amendment,
<br />Vesting Tentative Parcel Map, Downtown Planned Community Permit and Use Permit
<br />subject to Conditions of Approval for the Project, an Affordable Housing Plan, Land
<br />Donation Agreement with associated documentation and agreements, and a
<br />Development Agreement, and all other documents, reports, studies, memoranda, maps,
<br />oral and written testimony, and materials in the City’s file for the applications and the
<br />Project, and all adopted City planning documents relating to the Project and the property
<br />including the City’s General Plan, DTPP, Municipal Code, Zoning Ordinance, and other
<br />applicable City laws and regulations, and all associated approved and certified
<br />environmental documents for the Project (collectively referred to as the “Record”); and
<br />
<br />WHEREAS, the Planning Commission determined that the increase of the DTPP
<br />Maximum Allowable Development office capacity via the General Plan and DTPP
<br />Amendments was previously studied and cleared under the DTPP SEIR and was
<br />consistent with and would further the purpose of and appropriately implement the General
<br />Plan and DTPP goals, policies, development standards and guidelines, and all other
<br />applicable provisions of the Redwood City Municipal Code and Zoning Ordinance; and
<br />
<br />WHEREAS, following its deliberation on all of the foregoing, the Planning
<br />Commission adopted Resolution No. 24-07, determining that the Project is within the
<br />scope of the DTPP EIR and DTPP SEIR, and pursuant to Section Nos. 15168 and 15183
<br />of the CEQA Guidelines, recommending that the City Council find no further
<br />environmental review is required for the Project; and
<br />
<br />WHEREAS, the Planning Commission also recommended that the City Council
<br />approve the Project by approving the General Plan Amendment, DTPP Amendment;
<br />Affordable Housing Plan, Affordable Housing Partner, Land Donation and Land Donation
<br />Agreement; and Downtown Planned Community Permit; Vesting Tentative Parcel Map,
