ATTY/RESO.0070/CC RESO 1900 BROADWAY (CEQA) <br />REV: 10-23-24 VR <br />Page 4 of 5 <br />and Use Permit subject to Conditions of Approval; and a Development Agreement; and <br /> <br />WHEREAS, on October 28, 2024, the City Council of the City of Redwood City <br />conducted a duly noticed public hearing, in accordance with all applicable requirements <br />of the State Planning and Zoning Law, the Redwood City Code, and the Redwood City <br />Zoning Ordinance, to consider the CEQA Consistency Checklist; and <br /> <br />WHEREAS, after the public hearing, the City Council considered the whole of the <br />Record and following its deliberation on all of the forgoing, determined that the Project is <br />within the scope of the DTPP EIR and DTPP SEIR, and pursuant to Sections 15168 and <br />15183 of the CEQA Guidelines, and finds no further environmental review is required for <br />the Project; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The recitals set forth above are true and correct and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />Section 2. The City Council, having independently heard, considered, and <br />weighed all the facts and evidence in the Record, finds that the above recitals are <br />accurate and constitute findings in this matter and, together with the Project Record, have <br />served as an adequate and appropriate evidentiary basis for the findings and actions set <br />forth in this resolution. <br /> <br />Section 3. CEQA. In the exercise of its independent judgement, based on the facts <br />and evidence in the Record, the City Council finds that: <br /> <br />a. The CEQA Consistency Checklist was prepared in accordance with all legal <br />requirements. <br /> <br />b. The City Council has reviewed and analyzed the CEQA Consistency <br />Checklist and other information in the entire Record and has considered the <br />information contained therein, including the written and oral comments received at <br />the public hearing on the Project, prior to acting upon or approving the Project. <br /> <br />c. Based on substantial evidence in the record, the proposed Project is <br />adequately analyzed and addressed in the previously certified DTPP EIR and <br />DTPP SEIR for the purposes of CEQA. The Statement of Overriding <br />Considerations and MMRPs associated with the certification of the DTPP EIR and <br />DTPP SEIR address the environmental effects of the Project. Accordingly, with the <br />approval of this Project, all applicable mitigation measures and the Statement of <br />Overriding Considerations are hereby reconfirmed and readopted. <br /> <br />d. As indicated in the CEQA Consistency Checklist, 1) the DTPP applies form- <br />based code which regulates land development to achieve specific urban form and
