ATTY/RESO.0070/CC RESO 1900 BROADWAY (CEQA) REV: 10-23-24 VR Page 4 of 5 and Use Permit subject to Conditions of Approval; and a Development Agreement; and WHEREAS, on October 28, 2024, the City Council of the City of Redwood City conducted a duly noticed public hearing, in accordance with all applicable requirements of the State Planning and Zoning Law, the Redwood City Code, and the Redwood City Zoning Ordinance, to consider the CEQA Consistency Checklist; and WHEREAS, after the public hearing, the City Council considered the whole of the Record and following its deliberation on all of the forgoing, determined that the Project is within the scope of the DTPP EIR and DTPP SEIR, and pursuant to Sections 15168 and 15183 of the CEQA Guidelines, and finds no further environmental review is required for the Project; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: Section 1. The recitals set forth above are true and correct and are hereby incorporated herein by this reference as if fully set forth in their entirety. Section 2. The City Council, having independently heard, considered, and weighed all the facts and evidence in the Record, finds that the above recitals are accurate and constitute findings in this matter and, together with the Project Record, have served as an adequate and appropriate evidentiary basis for the findings and actions set forth in this resolution. Section 3. CEQA. In the exercise of its independent judgement, based on the facts and evidence in the Record, the City Council finds that: a. The CEQA Consistency Checklist was prepared in accordance with all legal requirements. b. The City Council has reviewed and analyzed the CEQA Consistency Checklist and other information in the entire Record and has considered the information contained therein, including the written and oral comments received at the public hearing on the Project, prior to acting upon or approving the Project. c. Based on substantial evidence in the record, the proposed Project is adequately analyzed and addressed in the previously certified DTPP EIR and DTPP SEIR for the purposes of CEQA. The Statement of Overriding Considerations and MMRPs associated with the certification of the DTPP EIR and DTPP SEIR address the environmental effects of the Project. Accordingly, with the approval of this Project, all applicable mitigation measures and the Statement of Overriding Considerations are hereby reconfirmed and readopted. d.
