TRIBAL CULTURAL RESOURCES <br />a) Would the project cause a substantial adverse <br />change in the significance of a tribal cultural <br />resource, defined in Public Resources Code § <br />21074 as either a site, feature, place, cultural <br />landscape that is geographically defined in <br />terms of the size and scope of the landscape, <br />sacred place, or object with cultural value to a <br />California Native American tribe, and that is: <br /> <br /> i) Listed or eligible for listing in the <br />California Register of Historical Resources, or <br />in a local register of historical resources as <br />defined in Public Resources Code section <br />5020.1(k), or <br />Not <br />Addressed <br />LTS with <br />Mitigation <br />LTS with <br />Mitigation No No No No <br /> ii) A resource determined by the lead agency, <br />in its discretion and supported by substantial <br />evidence, to be significant pursuant to criteria <br />set forth in subdivision (c) of Public Resources <br />Code § 5024.1. In applying the criteria set forth <br />in subdivision (c) of Public Resource Code § <br />5024.1, the lead agency shall consider the <br />significance of the resource to a California <br />Native American tribe. <br />Not <br />Addressed <br />LTS with <br />Mitigation <br />LTS with <br />Mitigation No No No No <br /> <br />Documentation: <br /> <br />1900 Broadway Component: <br />a. i) The DTPP Plan-Wide Amendments SEIR found that implementation of the DTPP Amendments would result in a <br />less than significant impact with mitigation (MM CR-3) in conjunction with compliance with the regulatory <br />framework. The DTPP Plan-Wide Amendments program SEIR (pp. 7-23 through 7-25) included explanation of <br />changes in State law since certification of the 2010 DTPP program EIR that require local governments to consult with <br />California Native American tribes regarding tribal cultural resources. The DTPP Plan-Wide Amendments program <br />SEIR (p. 24) described the City’s tribal outreach/notification process (letters sent to eight Native American tribes <br />identified by the Native American Heritage Commission) and the results (no responses received). In addition, the <br />results of a Native American Heritage Commission Sacred Lands File search for the DTPP SEIR did not identify <br />sacred lands within the DTPP area. MM CR-3 and compliance with the regulatory framework would reduce any <br />significant impacts to any unidentified resources that may be inadvertently discovered. <br /> Because no tribal cultural resources were identified, the project component would not cause a substantial adverse <br />change in the significance of a tribal cultural resource; no impact would occur, and no mitigation would be required. <br />No new or more severe impacts are anticipated that what was analyzed in the EIR/SEIR, and there is no new <br />information of substantial importance for CEQA purposes. <br /> ii) The DTPP program EIR included Mitigation Measure 7-1, requiring all project work to be stopped in the event <br />any deposits of prehistoric or historic archaeological materials are encountered during project construction activities, <br />with additional follow-up measures required for assessment of the resource and recommendations for avoidance, in- <br />place preservation, and/or recovery of the resource. The DTPP Plan-Wide Amendments program SEIR (pp. 7-21 <br />through 7-23) concurred with the DTPP EIR conclusion and includes Mitigation Measure CR-3, which restates <br />Mitigation Measure 7-1 from the DTPP Final EIR with minor text revisions (“clarifying amendments”). In addition, <br />the DTPP Plan-Wide Amendments program SEIR added the following requirement (p. 7-21): “The CRMP [Cultural <br />ATTY/RESO.0074/CC RESO 847 WOODSIDE (CEQA) - EXHIBIT 1 - CEQA CONSISTENCY CHECKLIST <br />REV: 10-23-24 VR <br /> <br />Page 120 of 135
