REV: 10-09-24 MI presentation of the final slides to the Utilities Sub-Committee. Consultant shall attend the meeting via video conference to assist with answering questions. Proposition 218 Notice Consultant shall draft a Proposition 218 notice, which shall include, but is not limited to, a 120-day statute of limitations for challenging the rates, a rate comparison with other cities, and other charts or similar visuals where appropriate. The Proposition 218 notice and mailing process shall also comply with Government Code sections 53759.1 and 53759.2. The Proposition 218 notice may be reviewed and revised by the Public Works Director or their designee(s). Consultant shall produce a final notice in Word format. The City will be responsible for printing and issuing all Proposition 218 notices, including receiving and tallying any protests submitted. Rate Reports Consultant shall document the results of their analysis in a Rate Report, which shall be provided for review in Word or Excel file format to the Public Works Director or their designee(s). The documentation shall explain how the methodology complies with Proposition 218, relevant court decisions, and other assumptions. Consultant shall revise the Rate Report as necessary, based on input from staff and any appropriate policy bodies. Following any final City comments, Consultant shall produce a Final Report in PDF format. The Final Report shall be finalized by the Consultant prior to the mailing of the Proposition 218 notice. Implementation Consultant shall revise (if necessary) the presentation made to the Utilities Sub- Committee to present final findings and recommendations to the City Council. Consultant shall be available to attend via video conference during the public hearing at the end of the 45-day protest period to answer questions. Municipal Code Review Consultant shall review and recommend changes to the appropriate chapter of the City’s Municipal Code to reflect the rate changes, as applicable. Project Management Consultant shall monitor schedules and budgets, conduct periodic status calls with City staff regarding the progress of the project, coordinate efforts, and other issues, and perform quality control checks to peer review analyses and work products. Consultant shall also track progress by task to ensure the project is within budget. Deliverables: Consultant shall provide: •Bi-weekly staff status meetings and agendas •Presentation to Utilities Sub-Committee •Proposition 218 notice •Rate Report •Attendance at one City Council for Proposition 218 hearing •Recommended Municipal Code changes ATTY/AGR.2024/Amend.
