This memorandum has been <br />prepared to serve as the basis for compliance with CEQA as it pertains to the proposed project, and <br />to demonstrate that the project qualifies for a CEQA Exemption as an Existing Facility, consistent <br />with the provisions of CEQA Guidelines Sections 15301. Specifically, the information and analysis <br />provided herein shows that the proposed project is exempt from CEQA and would not have a <br />significant effect on the environment because: <br />a. The proposed project falls under the Class 1 categorical exemption for existing facilities in <br />CEQA Guidelines Section 15301; and <br />b. None of the exceptions in CEQA Guidelines Section 15300.2 apply. <br />CEQA Guidelines Section 15301, Existing Facilities, defines Class 1 projects as those consisting of the: <br />“…minor alteration of existing public…..structures, facilities….involving negligible or no expansion of <br />existing or former use.” Pursuant to subsection (l) of Section 15301, projects that qualify for this <br />exemption include those involving the demolition and removal of individual small structures, <br />including accessory (appurtenant) structures. <br />As described above, the proposed project would deconstruct existing public structures and facilities <br />at the project site, including removal of the existing floating dock and berths and associated utilities. <br />All existing landside public recreational facilities and amenities, including a small watercraft launch <br />and in-water infrastructure (e.g., pillars) associated with the dock would remain. =. Existing facilities <br />to be removed include approximately 2,000 linear square feet of floating dock area and associated <br />utilities. The proposed project would not include the construction of any new structures or facilities <br />on the project site once deconstruction is complete. By removing the existing docks and associated <br />utilities and not constructing any new facilities in their place, the proposed project would result in <br />no expansion of use, but would, in fact, promote the cessation of the former marina use (e.g., <br />eliminate docking of boats). Therefore, the proposed project properly qualifies for an exemption <br />under CEQA Guidelines Section 15301 (i.e., Class 1) and, as a result, would not have a significant <br />effect on the environment. Additionally, as demonstrated by the analysis below, none of the <br />exceptions identified in CEQA Guidelines Section 15300.2 apply to negate the application of this <br />Class 1 categorical exemption. <br />6.G. - Page 14 of 45 <br />192
