<br />11/15/24 (P:\M-S\RWC2101.04 Docktown CE\PRODUCTS\Docktown_CEMemo_20241115.docx) 11 <br />EXCEPTIONS TO CATEGORICAL EXEMPTIONS <br />In addition to investigating the applicability of CEQA Guidelines Section 15301 (Class 1) to the <br />project, this memorandum assesses whether any of the exceptions to qualifying for the categorical <br />exemption are present. The following analysis compares the criteria of CEQA Guidelines Section <br />15300.2 (Exceptions) to the project. As described in the analysis below, none of the exceptions are <br />applicable to the project. <br />Criterion 15300.2(a): Location <br />a. Location. Classes 3,4,5,6, and 11 are qualified by consideration of where the project is to be <br />located – a project that is ordinarily insignificant in its impact on the environment may in a <br />particularly sensitive environment be significant. Therefore, these classes are considered to <br />apply in all instances, except where the project may impact on an environmental resource of <br />hazardous or critical concern where designated, precisely mapped, and officially adopted <br />pursuant to law by federal, state, or local agencies. <br />Projects that fall under the categorical exemptions in CEQA Guidelines Section 15301 are Class 1 <br />activities; therefore, because this sensitive environment location exception only applies to the class <br />3, 4, 5, 6, and 11 exemptions in CEQA Guidelines Sections 15303, 15304, 15305, 15306 and 15311, it <br />does not apply here. <br />Criterion 15300.2(b): Cumulative Impact <br />b. Cumulative Impact. All exemptions for these classes are inapplicable when the cumulative <br />impact of successive projects of the same type in the same place, over time is significant. <br />A cumulative impact from several projects is the change in the environment that results from the <br />incremental impact of the project when added to other closely related past, present, and reasonably <br />foreseeable probable future projects (CEQA Guidelines Section 15355(b)). The effects of the <br />proposed project would generally be beneficial, as the proposed project would remove remnant <br />infrastructure that is no longer in use. <br />As outlined in the project description, the adjacent property at 1548 Maple Street is currently under <br />development, and the creek-side area would be improved as part of that private development <br />project. Deconstruction activities associated with the proposed project would occur concurrently <br />with construction of the adjacent property. No other projects are anticipated to occur in the <br />immediate area of the proposed project at the same time. <br />The proposed project would generate temporary and short-term increases in particulate matter, <br />noise, and vehicle trips due to deconstruction activities and vehicles operating throughout the work <br />area. Any effects would be temporary, confined to the project vicinity and the demolition phase, <br />and would be less than significant due in part to the implementation of standard City conditions of <br />approval and existing, generally applicable regulatory requirements. The CEQA analysis prepared for <br />the 1548 Maple Street Project identified similar construction effects resulting from implementation <br />of the 1548 Maple Street Project and identified mitigation measures to reduce those impacts to a <br />less-then-significant level. <br />6.G. - Page 15 of 45 <br />193
