<br />32 <br /> <br /> <br />Family Medical Leave, Pregnancy Disability Leave, and California Family Rights <br />Act Leave will run concurrently with Parental Leave as permitted by law. <br /> <br />9.9 Absence Notification <br /> <br />Failure on the part of an employee to report for duty or notify the designated <br />management official one-half (1/2) hour prior to the employee's scheduled starting <br />time as to a reason why the employee cannot report may subject the employee to <br />disciplinary action. <br /> <br />9.10 Bereavement Leave <br /> <br />9.10.1 In the event of a death in the immediate family of an employee of the City, <br />that employee shall, upon request, be granted such time off with pay as is <br />necessary to make arrangements for the funeral and attend same, not to <br />exceed three (3) regularly scheduled working days or four (4) days in the <br />event the funeral is three hundred (300) or more miles from the City. An <br />employee may take additional unpaid bereavement leave for a total of five <br />(5) regularly scheduled working days; however, employees may use <br />accrued paid leave for the unpaid days. The five (5) days of bereavement <br />leave may be taken intermittently, but must be completed within three (3) <br />months of the family member’s date of death. <br /> <br />9.10.2 For the purpose of this provision, the immediate family shall be restricted <br />to parent, sibling, spouse, domestic partner, child, half-sibling, step <br />sibling, parent-in-law, grandparent, grandparent-in-law, great <br />grandparent, grandchild, great grandchild, stepparent, stepchild and step <br />grandchild. <br /> <br />9.10.3 In the event of the death of an active City employee, the City will excuse <br />(without loss of pay) those employees who wish to attend the locally <br />conducted funeral only to the extent it does not interfere with the operation <br />of the City. <br /> <br />9.10.4 Bereavement leave applies only in instances in which the employee <br />attends the funeral, or is required to make funeral arrangements, but is not <br />applicable for other purposes, such as settling the estate of the deceased. <br /> <br />9.11 Family and Medical Leave <br /> <br />In accordance with the California Family Rights Act of 1991 and the Family and <br />Medical Leave Act of 1993, qualifying employees are entitled to Family and <br />Medical Leave in accordance with City Administrative Policy in effect as of the <br />date of this agreement, and as subsequently amended, subject to notice to the <br />Association and the opportunity to meet and confer where required by law. <br /> <br />6.I. - Page 44 of 84 <br />274
