<br />58 <br /> <br /> <br />22.4 The department shall reserve the right to refer any claim, which is excessive or does <br />not meet the previously stated criteria, to the normal City of Redwood City claim <br />procedure. <br /> <br /> <br />SECTION 23. SEPARABILITY OF PROVISIONS <br /> <br />Should any section clause or provision of this MOU be declared illegal by final judgment <br />of a court of competent jurisdiction, such invalidation of such section, clause or provision <br />shall not invalidate the remaining portions hereof, and such remaining portions shall remain <br />in full force and effect for the duration of this MOU. <br /> <br />Upon such invalidation the parties agree to meet and confer concerning substitute <br />provisions rendered or declared illegal. <br /> <br />SECTION 24. JOINT LABOR MANAGEMENT COMMITTEE <br /> <br />The City and Association agree to establish a Joint Labor Management Committee <br />(“Committee”). The purpose of the Committee is to foster improved communication and a <br />cooperative relationship, and to review and to make recommendations on subjects of <br />mutual concern and interest. <br /> <br />The Committee will consist of four (4) representatives from the Association, two (2) <br />Department representatives and two (2) Human Resources representatives. <br /> <br />The Committee will meet on an as-needed basis, not to exceed once per month. Both the <br />Association and the City will be represented by Co-Chairs. The City Human Resources <br />Director or designee will be the Co-Chair for the City. The Co-Chairs will agree on an <br />agenda 24 hours in advance of the Committee meeting, which will then be distributed to <br />the Committee members. Failure to place an item on the agenda shall not preclude the <br />Committee from addressing any issue if sufficient information is available. <br /> <br />The Committee is in no way intended to supersede or negate the parties’ mutual obligation <br />to bargain in good faith or to supersede any portion of this Agreement, including but not <br />limited to the grievance procedure. The Committee process will not be a substitute for the <br />contractual grievance process.
