Government Code Section 66002 addresses the requirements for the adoption and annual <br />update of impact fee capital improvement plans, like the Parks and Transportation Impact Fee Project <br />Lists. Section 66002 provides that if the City adopts an impact fee capital improvement plan, the plan must <br />indicate the approximate expected location, size, time of availability, and an estimate of costs for all <br />facilities or improvements to be financed with the fees. <br />The capital improvement plan must be adopted by the City Council and annually updated by resolution of <br />the City Council adopted at a noticed public hearing. Notice of the public hearing shall be published at <br />least 10 days prior to the hearing and mailed to any city or county which may be significantly affected by <br />the plan. City staff has complied with these notice requirements and is submitting an updated Parks and <br />Transportation Impact Fee Project Lists to the Council for review and adoption. <br />The City’s Annual Parks Impact Fee Project List is in “Attachment A,” and the City’s Annual Transportation <br />Impact Fee Project List is in “Attachment B” to this report. <br /> <br />ANALYSIS <br /> <br />AB 602 went into effect on January 1, 2022, and adds additional requirements for development impact <br />fee programs and updates adopted under the Mitigation Fee Act. AB 602 requires, among other things, <br />the adoption of the nexus study supporting the fee update and the study’s associated “capital <br />improvement plan” for statutorily defined “large jurisdictions.” The City of Redwood City falls under the <br />definition of a “large jurisdiction.” The City’s Municipal Code also requires the City to maintain both a <br />Parks Impact Fee and a Transportation Impact Fee Project List, which lists all park improvements that are <br />intended to be funded by the parks impact fees and all transportation improvements that are intended to <br />be funded by the transportation impact fees. The Parks Impact Fee Project List, presented for adoption as <br />shown in Attachment A, and the Transportation Impact Fee Project List, presented for adoption, as shown <br />in Attachment B, meet AB 602’s requirement for adoption of a capital improvement plan and the City’s <br />Municipal Code requirements for the Parks and Transportation Impact Fee Project Lists. <br />The Parks Impact Fee Project List helps ensure that there is a need for the potential impact fee revenues <br />that are anticipated to be collected from the updated fees. The Parks Impact Fee Project List is developed <br />based on the 2019 Park Needs Assessment Study recommendations, including adding recreational <br />amenities, parks and playgrounds, athletic fields, facilities, and land acquisition for parks. The City’s <br />proposed updated Parks Impact Fee Project List (Attachment A) indicates potential investments, including <br />general project location, estimated size, estimated cost, and timeline. <br />The Transportation Impact Fee Project List helps ensure that there is a need for the potential impact fee <br />revenues that are anticipated to be collected from the updated fees. The Transportation Impact Fee <br />Project List is developed based on the 2023 Transportation Impact Fee Study recommendations and <br />includes both multi-modal, traffic operation, and roadway improvement projects as identified in the City’s <br />adopted transportation programs and required to support the growth envisioned in the City’s Focused <br />7.A. - Page 2 of 27 <br />38
