More information on this <br />effort will be provided in summer / fall 2025. <br />Recent Updates to State Laws <br />Since 2020, the California State Legislature has been extremely active in the area of housing policy and <br />tenant protections. Simultaneous to the City’s implementation of the ADS, new state laws have been <br />approved that provide additional protections to tenants. As such, the City should re-evaluate local ADS <br />goals in context of these new state protections. <br />Examples of these state laws include the following: The California Tenant Protections Act of 2019 (TPA), <br />also known as Assembly Bill (AB) 1482, which went into effect on January 1, 2020, and provides a <br />statewide annual rent cap, just cause eviction protections and some relocation assistance for most <br />California renters. The TPA is scheduled to sunset on January 1, 2030. <br />Senate Bill (SB) 567, which went into effect on April 1, 2024, amended sections of the no-fault just cause <br />provisions of the TPA to include additional protections in cases where owners intend to occupy a unit, or <br />intend to demolish or substantially remodel a property. More specifically, SB 567 requires specific <br />disclosure in notices (including providing the tenant a copy of the permit) if an owner displaces a tenant <br />due to demolition or substantial remodel of a unit and requires the right of return if demolition or <br />substantial remodel work is not commenced or completed. However, the law does not include the right <br />of return where a substantial remodel is completed. <br />The combination of the new laws—most notably AB 1482, SB 567, and the other measures outlined in <br />Attachment B—provides tenants with greater protections than those in place when the ADS was initially <br />approved in 2022 and when the City conducted community engagement on potential anti-harassment <br />and right of return policies in 2023. As shown in Table 5 below, staff recommends that the City host focus <br />groups to gather input on right-of-return considerations not currently addressed by state law. At the <br />conclusion of the process, staff would return to the City Council with a comprehensive Tenant Protection <br />Ordinance (TPO) that incorporates previously approved City Council policies (relocation assistance, <br />minimum lease terms, and just cause eviction protections) and any recent changes to state law. <br />With respect to tenants residing in mobile home parks, the legislature has implemented measures to <br />strengthen protections for these residents.
