Therefore, staff generally factor in contingency funding to facilitate these <br />needs when projecting final costs. Staff recommends awarding the project to PWA as the lowest <br />responsive and responsible bidder, and approval and authorization for the City Manager to execute an <br />agreement with Pacific Water Art, Inc. for a total amount not to exceed $271,600 and authorization for <br />the City Manager or their designee to increase the contract amount, if necessary, up to 15% of the amount <br />awarded in an amount not to exceed $40,740 for a total amount of $312,340. <br />FISCAL IMPACT <br />The amount of $248,058.82 is available in the Courthouse Square Improvements Account within the <br />Capital Outlay Fund. The remaining $23,541.18 and any contingency funding will be allocated from the <br />Tenant Improvement Program Account within the Capital Outlay Fund. <br />ENVIRONMENTAL REVIEW <br />This project meets the CEQA exemption criteria as set forth in CEQA Guidelines Section 15301 (Class 2 – <br />Replacement or Reconstruction) in that it involves the minor alteration of existing City Facilities with <br />negligible or no expansion of an existing use. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may elect not to award the agreement to Pacific Water Art, Inc. and direct staff to pursue <br />alternative solutions for completing the project. <br />REPORT PREPARED BY: <br />Aaron Nair, Public Works Superintendent <br />anair@redwoodcity.org <br />(650) 780-7474 <br />APPROVED BY: <br />6.G. - Page 3 of 4 <br />110
