ATTY/2024/ORD.0012/CC ORD AMENDING MUNI CODE CH 15 (SMOKING REGULATIONS) <br />REV: 01-14-25 JB <br />Page 2 of 3 <br />amusement parks, people could be exposed to levels of secondhand smoke that is <br />comparable to indoor concentrations where smoking is permitted5; and <br /> <br />WHEREAS, to be completely free from exposure to secondhand smoke in outdoor <br />places, a person may have to move 20 to 29 feet away from the source of the smoke, <br />about the width of a two-land road 6; and <br /> <br />WHEREAS, the City Code and State Law currently prohibit smoking in various <br />portions of the City, including buildings, restaurants, parks, and within 20 feet of City- <br />owned parks, facilities, library, and other government buildings; and <br /> <br />WHEREAS, the City Council finds that regulating smoking within areas of <br />Redwood City with high pedestrian traffic will protect the population from secondhand <br />smoke exposure; and <br /> <br />WHEREAS, amendment of Chapter 15 (Smoking Regulations) is in the best <br />interest of the City, and Article XI, Section 7 of the California Constitution allows cities to <br />make and enforce local ordinances and regulations not in conflict with the general laws <br />of the State; and <br /> <br />WHEREAS, the City Council has reviewed and considered the determination <br />under the California Environmental Quality Act (“CEQA”) prior to taking any approval <br />actions; and <br /> <br />WHEREAS, the City Council considered the Chapter 15 amendments at its regular <br />meeting on January 13, 2025, along with the staff report, supporting documentation, staff <br />presentations, public comment, and information included in the record. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />Section 2. The proposed Ordinance is not a project within the meaning of Section <br />15378 of the CEQA Guidelines because it has no potential for resulting in physical change <br />in the environment. In the vent that this Ordinance is found to be a project under CEQA, <br />it is subject to CEQA exemption contained in CEQA Guidelines Section 15061(b)(3) <br />because it can be seen with certainty to have no possibility of a significant effect on the <br />environment. <br /> <br />5 CARB.
