REV: 01-16-24 MI <br />d) Vertical acceleration and deceleration <br />e) Leveling <br />Contractor will maintain a smooth, comfortable ride during acceleration, running and <br />deceleration. Door operation will be smooth and quiet during all modes of operation. <br />Contractor is responsible for providing, as its own expense, all necessary tools and <br />instruments to perform tests substantiating its ability to maintain all facets of the <br />equipment. <br />7) Wiring and Construction Prints <br />All wiring and construction prints or diagrams of elevator systems in City buildings <br />covered under the Agreement are the property of the City and upon termination of the <br />Agreement shall be delivered to Facilities Manager. All changes in circuitry made by <br />the Contractor shall be properly recorded on the diagrams, including the date of the <br />change and the name of the person making the change. At any time changes are <br />made, the Contractor shall give the Facilities Manager a copy of the revisions. <br />8) Call-Backs <br />Contractor shall provide unlimited call-back service at no additional cost to the City <br />during regular working hours (Monday through Friday 7:00 a.m. to 4:00 p.m.). <br />Contractor shall also provide emergency call-back service outside regular working <br />hours, including weekends and holidays, at the hourly labor rates specified. Contractor <br />shall respond to City’s service calls twenty four (24) hours per day, seven (7) days per <br />week, and three hundred sixty-five (365) days per year. <br />Contractor shall provide prompt service in the event of improper functioning of the <br />elevators. In the event of an emergency call (a passenger entrapment or actual <br />imminent physical or psychological damage to the user of the elevator), the Contractor <br />shall respond within sixty (60) minutes of placement of the call by the City. Since the <br />determination of actual damages for any failure or delay in performance of this <br />requirement would be extremely difficult or impractical to determine in the event of <br />such failure or delay, Contractor agrees that it shall be liable for and pay to the City <br />liquidated damages of Two Hundred dollars ($200.00) for each thirty (30) minute delay <br />beyond the acceptable response time. Contractor agrees to pay said liquidated <br />damages as herein provided, and in case the same are not paid, agrees that City may <br />deduct the amount thereof from monies due or that may become due to the Contractor. <br />In the event of non-emergency calls during business hours, the Contractor shall <br />provide service within three (3) hours of placement of the call by the City. Upon <br />approval by the Facilities Manager, additional time may be allowed. If the call comes <br />in during nonbusiness hours, the Contractor shall respond by 10:00 a.m. the next <br />business day.
