REV: 01-16-24 MI <br />10) Removal of Elevators from Service and Major Repairs <br />Contractor will coordinate and obtain approval from the Facilities Manager prior to <br />removal of elevators from service. <br />In the event major repair work becomes necessary, the Contractor will provide <br />separate repair personnel to accomplish the work to ensure that regular service <br />personnel continue with their normal preventive maintenance of the equipment. <br />11) Performance of Contractor <br />General: <br />Contractor shall ensure that only skilled and competent workers perform work under <br />the Agreement, and that those workers perform all work in a timely, neat, and orderly <br />manner. City may refuse to accept work or workers who do not meet these standards. <br />Contractor shall be responsible for any damage caused by Contractor’s operations <br />and shall repair or replace, as directed by the City, said damage within a reasonable <br />time. <br />Down Time: <br />If an elevator is inoperative for more than fifteen (15) minutes, Contractor shall post a <br />sign at each entrance indicating that the elevator is out of service. <br />City’ s Right to Inspect and Require Work: <br />The City reserves the right to make such inspections and tests whenever necessary <br />to ascertain that the requirements of this Agreement are being fulfilled. Deficiencies <br />noted shall be promptly corrected at Contractor's expense. <br />Warranty of Work: <br />Contractor will repair or replace during normal working hours and without additional <br />cost to City any covered component that has been repaired or replaced during the <br />term of the Agreement and that proves defective for a period of twelve (12) months <br />following the completion of such repair or replacement. City agrees to give Contractor <br />prompt written notice when becoming aware of such defect. Such warranty by <br />Contractor shall run concurrently to any manufacturer’s warranties or guarantees. <br />Contractor shall not be required to correct without charge; breakage, maladjustments, <br />or other trouble arising from abuse, misuse, improper or inadequate maintenance by <br />others, or any other cause beyond Contractor’s reasonable control. In the event that <br />the Agreement expires or if this Agreement is terminated by Owner for any reason <br />other than for cause all of Contractor’s remaining warranty obligations hereunder shall <br />90 days following the effective date of such termination. <br />ATTY/AGR.2024.006/Star Elevator, Inc.
