7 <br />Section 4 describes the building and design <br />requirements that are applicable to Parklets <br />and Sidewalk Cafes. <br />The design standards and guidelines in this <br />section are organized first according to the <br />requirements applicable to all Parklets and <br />Sidewalk Cafes (Section 4A), followed by <br />requirements applicable only to Parklets located <br />within the Roadway (Section 4B), then finally <br />by requirements applicable only to Pedestrian <br />Street Parklets & Sidewalk Cafes (Section 4C). <br />Plans submitted with an application must reflect <br />these requirements. <br />A REQUIREMENTS APPLICABLE ALL <br />PARKLETS AND SIDEWALK CAFES <br />The following design standards and guidelines <br />apply to Outdoor Business Activity on Sidewalks, <br />Roadways, and Pedestrian Streets. <br />Applications that do not address all of the design <br />requirements specific to a proposed location <br />will be returned to the Applicant for revision and <br />resubmittal. <br />I. LOCATION, SIZE, SETBACK, AND <br /> CLEARANCE REQUIREMENTS <br />1 Location Requirements: The space(s) <br />utilized for a Parklet or Sidewalk Cafe <br />shall be aligned with the Applicant’s <br />business frontage. If the proposed <br />area extends beyond the frontage of <br />the Applicant’s business, the Applicant <br />must receive written consent from the <br />neighboring business owner and property <br />owner. Where specific conditions exist, <br />such as a fire hydrant, loading zone, <br />accessible parking space, or other existing <br />impediment, the Applicant shall work <br />with City staff to explore whether any <br />impediment can be relocated, and/or <br />identify an approved alternative space <br />proximate to the Applicant’s business. <br />Please note that it may be that no such <br />place exists. <br />2 Size Requirements: There is no <br />maximum or minimum size for a Parklet <br />or Sidewalk Cafe. The Annual Use of Space <br />Fee is calculated on a square-foot basis for <br />Parklets and Sidewalk Cafes. <br />3 Setback and Clearance Requirements: <br />Parklets and Sidewalk Cafes must maintain <br />the following minimum setbacks and <br />clearances (see also Diagrams 2 and 3). <br />a. A 5-foot clear path shall be maintained <br />within the Pedestrian Zone. All adjacent <br />crosswalks, business entrances and exits <br />(including emergency exits), as well as <br />Parklet and Sidewalk Cafe entrances <br />must intersect with the Pedestrian <br />Zone with a minimum 5-foot width <br />unobstructed path of travel. Crosswalks <br />are considered within the Vehicular Zone <br />and pedestrian access must extend from <br />crosswalks to the Pedestrian Zone. No <br />physical barriers, including Movable or <br />Fixed Improvements, may impede access <br />from the crosswalk to the Pedestrian <br />Zone. See Diagram 2. <br />b. On blocks with parallel parking, no <br />Parklet or Sidewalk Cafe features such <br />as seating or planters may be placed <br />in the Buffer Zone adjacent to active <br />parking spaces. <br />c. A 5-foot clearance between two or more <br />adjacent Parklets or Sidewalk Cafes shall <br />be maintained. The overall passage <br />dimension may be split between <br />adjoining Parklets or Sidewalk Cafes. <br />d. For Parklets, 2.5 feet from a driveway flare. <br />e. For Parklets, 20 feet from an <br />intersection or crosswalk <br />f.
