20 Overhead Structures are a special allowance with a longer review and approval process subject to staff discretion and a higher plan review and construction cost. Concurrent Planning entitlement and Building Permit review is not accepted. Applications submitted for Building Permit review will be placed on hold until all required Planning entitlements are obtained. All submittal processes and checklists are available on the Outdoor Business Activity webpage (See Section 3). Overhead Coverings are not considered Overhead Structures. There are example photos of preferred and discouraged approaches in Section 8. Where allowed, Overhead Structures may be located on either side of the sidewalk (i.e. curbside or adjacent to the fronting building), but the preferred location is adjacent to the building (See Diagrams 12 & 13), subject to consistency with these Guidelines. Planning will review any proposed Overhead Structures to ensure sufficient light, transparency, and visibility for pedestrians, traffic, businesses, and other site-specific conditions, both from the sides and from below (through the Overhead Structure). The Planning Division may require modifications or deny a proposed Overhead Structure based on the following criteria. If approved by the Planning division, the Applicant shall obtain a Building Permit for the Overhead Structure, which will be reviewed as part of the Building Permit plan review process. The permit set shall include the site plan and elevation drawing of the Parklet, consistent with the Planning entitlement, with the Overhead Structure, along with any additional details and full calculations prepared by a licensed engineer. I. SETBACK AND CLEARANCE REQUIREMENTS 1 Vertical clearance: 7 feet above the finished floor level 2 Pedestrian Path Clearance (Structure Adjacent to a Building): 5-foot-wide, clear path within the Pedestrian Zone adjacent to the Overhead Structure 3 Pedestrian Path Clearance (Structure Not Adjacent to a Building): 8-foot-wide clear path between the Overhead Structure and the business frontage II. MATERIAL REQUIREMENTS 1 Wind barrier materials, if used, shall be made of transparent materials such as acrylate, plexiglass, or plastic films and shall be either completely clear or lightly tinted. At a minimum, materials shall provide transparency level equal to or greater than 90% light transmission. 2 Overhead Structure roof materials shall be made of transparent materials such as acrylate, plexiglass, or plastic films and shall be either completely clear or lightly tinted. At a minimum, materials shall provide transparency level equal to or greater than 45% light transmission. The following exceptions are allowed: a. If non-transparent Overhead Structure materials are used (including obscured materials), it shall not exceed 40% coverage of the Parklet area. b. If a Parklet with an Overhead Structure is located directly adjacent to a building and the Pedestrian Zone is between the parklet and the roadway, solid materials are allowed for the Overhead Structure roof. c. Solid columns or beams may be incorporated to support the Overhead Structure and wind barrier, but visual transparency must be maintained along at least 90% of the Parklet exterior between the Overhead Structure and any Parklet barrier. II. OTHER REQUIREMENTS 1 Overhead Structures are not permitted directly under or adjacent to awnings, canopies, or other coverings affixed to the adjacent building.
