20 <br />Overhead Structures are a special allowance <br />with a longer review and approval process <br />subject to staff discretion and a higher plan <br />review and construction cost. Concurrent <br />Planning entitlement and Building Permit review <br />is not accepted. Applications submitted for <br />Building Permit review will be placed on hold <br />until all required Planning entitlements are <br />obtained. All submittal processes and checklists <br />are available on the Outdoor Business Activity <br />webpage (See Section 3). Overhead Coverings are <br />not considered Overhead Structures. There are <br />example photos of preferred and discouraged <br />approaches in Section 8. <br />Where allowed, Overhead Structures may <br />be located on either side of the sidewalk (i.e. <br />curbside or adjacent to the fronting building), <br />but the preferred location is adjacent to the <br />building (See Diagrams 12 & 13), subject to <br />consistency with these Guidelines. <br />Planning will review any proposed Overhead <br />Structures to ensure sufficient light, <br />transparency, and visibility for pedestrians, <br />traffic, businesses, and other site-specific <br />conditions, both from the sides and from below <br />(through the Overhead Structure). The Planning <br />Division may require modifications or deny <br />a proposed Overhead Structure based on <br />the following criteria. <br />If approved by the Planning division, the <br />Applicant shall obtain a Building Permit for the <br />Overhead Structure, which will be reviewed as <br />part of the Building Permit plan review process. <br />The permit set shall include the site plan and <br />elevation drawing of the Parklet, consistent with <br />the Planning entitlement, with the Overhead <br />Structure, along with any additional details and <br />full calculations prepared by a licensed engineer. <br />I. SETBACK AND CLEARANCE REQUIREMENTS <br />1 Vertical clearance: 7 feet above the <br />finished floor level <br />2 Pedestrian Path Clearance (Structure <br />Adjacent to a Building): 5-foot-wide, clear <br />path within the Pedestrian Zone adjacent to <br />the Overhead Structure <br />3 Pedestrian Path Clearance (Structure <br />Not Adjacent to a Building): 8-foot-wide <br />clear path between the Overhead Structure <br />and the business frontage <br />II. MATERIAL REQUIREMENTS <br />1 Wind barrier materials, if used, shall be <br />made of transparent materials such as <br />acrylate, plexiglass, or plastic films and <br />shall be either completely clear or lightly <br />tinted. At a minimum, materials shall provide <br />transparency level equal to or greater than <br />90% light transmission. <br />2 Overhead Structure roof materials shall <br />be made of transparent materials such as <br />acrylate, plexiglass, or plastic films and <br />shall be either completely clear or lightly <br />tinted. At a minimum, materials shall provide <br />transparency level equal to or greater <br />than 45% light transmission. The following <br />exceptions are allowed: <br />a. If non-transparent Overhead Structure <br />materials are used (including obscured <br />materials), it shall not exceed 40% <br />coverage of the Parklet area. <br />b. If a Parklet with an Overhead Structure <br />is located directly adjacent to a building <br />and the Pedestrian Zone is between the <br />parklet and the roadway, solid materials <br />are allowed for the Overhead Structure <br />roof. <br />c. Solid columns or beams may be <br />incorporated to support the Overhead <br />Structure and wind barrier, but visual <br />transparency must be maintained along <br />at least 90% of the Parklet exterior <br />between the Overhead Structure and any <br />Parklet barrier. <br />II.
