<br />14 <br /> <br /> <br />A. Tier One Bilingual Pay: For employees in the job classifications of Police Sergeant and <br />Police Lieutenant as of September 13, 2021 who are receiving bilingual premium pay as <br />of September 13, 2021: <br />1. For employees receiving the 2.5% level of bilingual premium as of September 13, <br />2021: Employees who are routinely and consistently assigned to positions requiring <br />communication in languages other than EnglishSpanish are eligible as listed herein, <br />with Department Head approval, to receive a two and one-half percent (2.5%) base pay <br />differential for the use of these skills in job duties arising during the normal course of <br />work as emergency responders. <br />2. For employees receiving the 5% level of bilingual premium as of September 13, 2021: <br />Employees with advanced bilingual skills who are routinely and consistently assigned <br />to positions requiring communication in languages other than English are <br />eligibleSpanish, with Department Head approval, to receive a five percent (5%) base <br />pay differential for the use of these advanced skills in job duties arising during the <br />normal course of work as emergency responders. Advanced bilingual skills, for <br />purposes of the five percent (5%) pay differential, are defined as the ability to translate <br />and communicate beyond conversational speaking and/or basic writing including the <br />ability to translate Spanish well enough to conduct intense suspect and victim <br />interviews at a level that will hold up in court. Employees that accept the five percent <br />(5%) pay would be required to agree, when called upon, to translate citywide and be a <br />spokesperson for the police department when communications between the Spanish <br />press and the police department are needed. Current eEmployees who: have advanced <br />bilingual skills (as described above) in one of the languages listed in Section <br />7.10(B)(5), and who passed a test as determined by the Personnel Officer or designee <br />within six (6) months of City Council approval of thea successor MOU in 2021, and <br />who are approved for bilingual pay by the department head will are also be eligible to <br />receive a five percent (5%) base pay differential for the use of these advanced bilingual <br />skills in job duties arising during the normal course of work. <br /> <br />3. Bilingual skills shall not be a condition of employment except for employees who are <br />hired specifically with that requirement. If an employee is hired under this provision, <br />that requirement shall be included in the initial appointment letter. <br />4. To retain the two and one-half percent (2.5%) or five percent (5%) differential, <br />employees will be required to pass the City’s proficiency test once every three (3) <br />years. <br />5. The City has the right to discontinue the bilingual differential at any time based on <br />changes to the City’s business needs, provided that the City gives the exclusive <br />representative ten (10) days’ notice prior to such revocation, in order to allow the <br />opportunity for the parties to meet and confer. <br />B. Tier Two Bilingual Pay: For all other employees, including current employees who achieve <br />new or more advanced bilingual skills during the term of the MOU, eligibility for <br />Emergency ResponderTier Two Bilingual Premium Pay is as follows: <br /> <br />1. Proficiency Level: Employees with proficient bilingual skills who are routinely <br />and consistently assigned to positions requiring communication in languages other <br />than English and that are listed in subsection “5” are eligible to receive a pay <br />differential of two and one-half percent (2.5%) of top step base pay for Police <br />6.H. - Page 22 of 72 <br />364
