<br />26 <br /> <br />Payment shall be made at fifty percent (50%) of the unused sick leave hours <br />accrued in the calendar year when no more than twelve and one half (12.5) hours <br />of sick leave have been used in the first twenty-six (26) pay periods. <br /> <br />The City will endeavor to make payment on the non-payroll Friday immediately <br />following the first payroll Friday in January following the year in which the leave <br />is accrued; however, the payment will be made no later than the first pay period in <br />February and shall be paid using the salary in effect December 31. There shall be <br />no payment in lieu of accumulated sick leave benefits for years prior to such <br />calendar year. <br /> <br />Use of Personal Business Leave shall be excluded from the definition of sick leave <br />usage for the purposes of calculating sick leave buyouts. <br /> <br />Accumulated sick leave credits shall be reduced by the value of the sick leave <br />compensated as provided in the above paragraph and the remaining balance shall <br />be accumulated to a maximum of one thousand three-hundred and seventy (1,370) <br />hours in accordance with Section 9.1.1. <br /> <br />Upon separation from City service for reason other than death, retirement or <br />discharge, compensation in lieu of unused, accrued sick leave shall be paid in the <br />amount provided in Section 9.1.3 for an employee who elects to receive <br />compensation in lieu of sick leave credits, prorated to the date of termination of <br />service. <br /> <br />Employees with twenty (20) years of service with the City, who retire from City <br />employment with benefits from PERS, shall be eligible to receive compensation <br />for fifty percent (50%) of accrued unused sick leave. <br /> <br />Accrued, unused sick leave at the time of retirement from the City (defined as <br />CalPERS retirement within one hundred twenty (120) days of separation from the <br />City), which has not been converted to compensation as provided within this <br />section, will be reported to CalPERS for conversion to service credit. <br /> <br />Employees who die while in the employ of the City shall be eligible to receive <br />compensation for twenty-five percent (25%) of accrued sick leave. <br /> <br />Employees who die in the line of duty or whose death is determined to be directly <br />attributable to injury or illness sustained while on duty shall be eligible to receive <br />compensation for one hundred percent (100%) of accrued unused sick leave. <br /> <br />In the event of the death of an employee, such payments shall be made to the <br />designated beneficiary filed with the Director of Finance, or, in the event no <br />designated beneficiary has been chosen, the beneficiary listed in the employee’s <br />insurance policy shall receive payment of such unused sick leave in the applicable <br />amount as provided in this Section. <br /> <br />Employees discharged for disciplinary reasons shall not be eligible for payment of <br />unused sick leave. <br /> <br />9.2 Industrial Disability Leave <br />6.H. - Page 34 of 72 <br />376
