<br />37 <br /> <br />Participating employees assigned to patrol who are not eligible for on-duty <br />workout time may elect to receive a stipend of $62.50 per month or up to seven <br />hundred fifty dollars ($750) per fiscal year for a gym membership or other fitness <br />activities instead of regular On Duty Fitness Time in order to participate in the <br />Wellness Program. The fitness activity reimbursement is subject to approval of the <br />Human Resources Director or designee. The usage and request for reimbursement <br />must occur between June 1st and May 31st each fiscal year. Taxability of this <br />benefit allowance is governed by the provisions of the Internal Revenue Code and <br />State and local regulations. <br /> <br />10.8.43 Employee Availability: An employee’s ability to participate in the Wellness <br />Program on any given day is subject to supervisor approval based on staffing <br />needs. All employees participating in the Wellness Program are required to be <br />available by mobile telephone or radio while exercising, and may be required to <br />return to duty without undue delay (including no opportunity to shower). <br /> <br />10.8.54 Minimum Health Requirement: If an employee is restricted by a doctor from <br />working full-duty, the employee must present a doctor’s note for continued <br />participation in the wellness program, with or without modifications or restrictions. <br /> <br />SECTION 11. PROBATION <br /> <br />11.1 All appointments shall be tentative and subject to a probationary period of twelve (12) <br />months of service from the date of appointment. During the probationary period an <br />employee may be rejected at any time by the City Manager upon recommendation of the <br />Police Chief. Any regular employee rejected during the probationary period shall be <br />reinstated to the position from which they were promoted unless conditions warrant the <br />employee’s dismissal. <br /> <br />Any employee promoted to the rank of Police Sergeant who, within the previous twelve <br />(12) months, served in the capacity of an Acting Police Sergeant for at least six (6) months <br />will be subject to a probationary period of six (6) months of service from the date of <br />appointment instead of twelve (12). <br /> <br />Any employee promoted to the rank of Police Lieutenant who, within the previous twelve <br />(12) months, served in the capacity of an Acting Police Lieutenant for at least six (6) <br />months, will be subject to a probationary period of six (6) months of service from the date <br />of appointment instead of twelve (12). <br /> <br />Employees on probation who are off work or on light duty for more than thirty (30) work <br />days shall have their probationary period extended by the same amount of time as the work <br />absence or light duty assignment. <br /> <br />Upon satisfactory completion of such probationary period, the employee shall be appointed <br />to a regular full-time position in that classification. <br /> <br />11.2 Employees appointed to specialty positions are appointed for a fixed period of time, (i.e. <br />three (3) years). However, employees may be removed from those positions prior to the <br />expiration of that time period for poor performance, in accordance with the following <br />method: <br /> <br />6.H. - Page 45 of 72 <br />387
