<br /> <br />00059814-1 <br /> 7 <br />construed to require the City to meet and confer on matters which are solely a function of management, <br />including the right to direct the work force; to select and determine the number and types of employees <br />required; to determine the content of job classifications; to hire, transfer, promote, suspend, discipline and <br />discharge employees; to assign work to employees in accordance with the requirements of the City; to <br />establish and change work schedules and assignments; to lay off employees for lack of work; to expand or <br />diminish services; to subcontract any work or operations; to determine and change methods of operations; <br />to determine and change work locations and the processes and materials to be employed; to take all <br />necessary actions to perform its functions in emergencies. <br /> <br /> <br />ARTICLE 5 - OFFICIAL REPRESENTATIVES <br /> <br />A maximum of four (4) Association representative unit members shall be allowed concurrent time off without <br />loss of compensation to represent the Association in the meet and confer process. The Association shall <br />submit the names of these unit representatives to the Personnel Officer at least two (2) working days prior to <br />scheduled meet and confer sessions, and the representatives shall advise their supervisors in advance prior <br />to leaving their work assignments to attend such meetings. <br /> <br /> <br />ARTICLE 6 - LAYOFF AND RE-EMPLOYMENT <br /> <br />6.1 Layoff <br /> <br />Whenever in the judgment of the City Council it becomes necessary in the interest of economy or because <br />the position involved no longer exists, the City Council may abolish any position or employment in the <br />competitive service, and the employee holding such position or employment may be laid off without the filing <br />of written charges. Any appointing power may likewise lay off a regular employee whenever lack of work or <br />lack of funds requires a reduction in the number of employees. <br /> <br />6.2 Notification of Layoff <br /> <br />The City shall notify the Association no less than thirty (30) calendar days prior to any employee being laid <br />off. Upon written request of the Association to the Personnel Officer, the City will meet to discuss the <br />conditions causing the layoff and the impact upon classifications in the bargaining unit. Such discussions <br />shall be without recourse to the grievance procedure. <br /> <br />6.3 Order of Layoff <br /> <br />In the event of a reduction in force, bargaining unit members with the shortest length of service in the <br />classifications affected shall be laid off first. If two employees have equal length of service in a <br />classification, the order of seniority shall be determined by standing on the eligibility list. If two employees <br />have equal length of service in a classification and the same standing on the eligibility list, the order of <br />seniority shall be determined by employment test score. <br /> <br />6.4 Bumping Rights <br /> <br />Any unit member laid off under the terms of this article may, if he or shethey so elects, be reassigned to a <br />position in a lateral or lower related classification within the same department which is held by an employee <br />having less service with the City. Such reassignment shall occur only in the event the employee is capable <br />by virtue of prior training and experience to perform the work required. <br /> <br />6.I. - Page 21 of 119 <br />435
