<br /> <br />00059814-1 <br /> 6 <br /> <br />Notwithstanding the foregoing, limited to the express purpose of the requirements of Government Code <br />section 3558 only, an employee may opt out via written request to the City (with a copy to the Association) <br />to direct the City to withhold disclosure of the employee’s home address, home telephone number, personal <br />cellular telephone number, personal email address, and birth date. <br /> <br />The parties agree that this Section fully complies with and exhausts the parties’ obligation to negotiate <br />pursuant to Government Code Sections 3557 and 3558. <br /> <br />For temporary employees hired in the positions represented by this bargaining unit, the City will provide the <br />Association with the anticipated length of employment within five (5) days of hire. The Association <br />acknowledges that job descriptions, wage rates, eligibility for benefits, and procedures to apply for open, <br />permanent positions are publicly available online. <br /> <br />3.4 Dues Deduction <br /> <br />The Association may have the regular dues of its members deducted from employees' paychecks under <br />procedures prescribed by the City. Dues deduction shall be made only upon certification from the <br />Association that an employee has authorized such deduction. After the initial certification of dues deduction <br />authorizations, the Association will send a list of membership changes to the City, certifying that the <br />Association possesses and will maintain an authorization for dues deductions signed by the individuals on <br />the list from whose salary or wages the deductions is to be made. <br /> <br />The City and the Association agree that such written certification is a condition precedent to the City's <br />obligation to begin a payroll deduction. <br /> <br />Dues deduction shall continue until: (1) such certification is revoked, in writing, by the Association; (2) the <br />employee is transferred to a bargaining unit represented by another employee organization; or (3) the <br />employee separates from City employment. <br /> <br />Dues deduction shall be suspended during any unpaid leave of absence. <br /> <br />The Association shall indemnify, to the extent permitted by law, defend and save the City harmless against <br />any and all claims, demands, suits, orders or judgments, or other forms of liability that arise out of or by <br />reason of this dues deduction section, or action taken or not taken by the City under this Section. This <br />includes, but is not limited to, the City's attorneys' fees and costs. <br /> <br />3.5 No Strike <br /> <br />The Association, its members and representatives, agree that it and they will not engage in, authorize, <br />sanction, or support any strike, slowdown, stoppage of work, curtailment of production, concerted refusal of <br />overtime work, refusal to operate designated equipment (provided such equipment is safe and sound) or to <br />perform customary duties by members of the bargaining unit; and neither the Association nor any <br />representatives thereof shall engage in job action for the purpose of effecting changes in the directives or <br />decisions of management of the City or to effect a change of personnel or operations of management or of <br />employees not covered by this MOU. <br /> <br />ARTICLE 4 - CITY RIGHTS <br /> <br />Except as required by the Meyers-Milias Brown Act and Article 3.2, to insure that the City is able to carry out <br />its constitutional, chartered and statutory functions and responsibilities, nothing contained herein shall be <br />6.I. - Page 20 of 119 <br />434
