This Amendment 1 would push the total contract amount over the $108,000 <br />threshold, so City Council approval is required. Staff recommend that the City Council approve <br />Amendment No. 1 to the Agreement for Services to increase the contract’s do-not-exceed amount by <br />$250,000 for a total of $350,000, and to extend the contract by 2 years for a total of 4 years. This <br />Amendment No. 1 also increases the hourly rate to account for cost of living increase for the consultant, <br />and modifies the independent contractor language to match new template language that the City has <br />implemented since the original contract was executed. <br />Margaret Netto (of Netto Planning Services, LLC) is a highly experienced project planner serving multiple <br />cities on the Peninsula. She has experience managing consultants on major and long-term development <br />review projects. She is serving as the City's Contract Principal Planner/Project Manager for the Redwood <br />Life project and assists with other larger development review projects to provide staff capacity. As the <br />Redwood Life project is ongoing and requires continued specialized consultant assistance, Amendment 1 <br />adds $250,000 to the contracted do-not-exceed amount, for a total contract amount of $350,000, and <br />extends the contract terms by 2 years, for a total of 4 years. <br />Agreement Amount Time Period <br />Original Agreement $100,000 March 20, 2023 – March 20, 2025 <br />(2 years) <br />Amendment No. 1 (Proposed)$250,000 March 21, 2025 – March 21, 2027 <br />(2 years) <br />Total $350,000 March 20, 2023 – March 21, 2027 <br />(4 years) <br />FISCAL IMPACT <br />Services rendered under this contract are funded by cost recovery agreements with project applicants. <br />Netto Planning Services, LLC’s primary focus, is Redwood Life, a development project that has an ongoing <br />open cost recovery agreement with the City. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />6.N. - Page 2 of 8 <br />578
