The purpose of the local code is to require certain employee classifications (in addition to Code <br />87200 filers) to make some level of economic disclosure, depending upon their position and likelihood <br />of influencing decisions where they might have an economic interest at stake. According to the Fair <br />Political Practices Commission (FPPC) “...the code must list all agency positions that involve the <br />making or participation in making of decisions that ‘may foreseeably have a material effect on any <br />financial interest’.” The Conflict of Interest Code designates employees, members of boards, <br />commissions or committees, City officers, and consultants if applicable, who by virtue of their <br />positions, make or participate in making decisions which may affect their financial interests and who <br />therefore must disclose these interests on the Fair Political Practices Commission Form 700 - <br />Statement of Economic Interests of Designated Employees. <br />New legislation has changed the filing process for 87200 filers. AB 1170, which took effect January 1, 2025, <br />requires all positions identified under California Government Code §87200 to file all Statements of <br />Economic Interest (Form 700s) directly, and electronically, through the Fair Political Practices <br />Commission’s (FPPC) online system. Those filers are identified in the updated Code, as well as on the City’s <br />website, and have been provided guidance on filing procedures moving forward. <br />The Political Reform Act further requires government agencies to review their local Conflict of Interest <br />Code every two years to determine whether the Code must be amended. Amendments may include <br />addition or deletion of positions, changes in position titles or changes to designation of disclosure <br />categories. <br />The last review and update of the City’s Conflict of Interest Code occurred in November 2022. City staff <br />reviewed the Code and have determined changes are required. Accordingly, the City Council is required <br />to approve an update to the Code. Typically, this update would be completed by the end of even- <br />numbered years, however due to increased workload in the fall/winter of 2024, and to ensure accuracy <br />of current employee classifications, drafting the revised Code was slightly delayed. <br />Since the Code was last updated, there have been changes to the City’s organizational structure which <br />affected positions subject to the Code: <br />The Administrative Services Department has been split into the Finance Department, Human <br />Resources Department and Information Technology Department <br />The Community Development and Transportation Department has been split into the Community <br />Development Department and Engineering and Transportation Department <br />The Geographic Information Systems Division has moved to the IT department <br />The City Clerk’s office has merged with the City Manager’s office <br />Following review, staff recommends the following changes to the Code. <br />The following positions are added: <br />Administrative Secretary <br />Assistant Community Development Director <br />6.C. - Page 2 of 18 <br />68
