6.18
Page 2

proposes to remove and reseal an unexpected secondary containment pipe and to
increase the size of the pipe, fittings and other materials. To limit potential risk of delay
damages, contractor incurred overhead, and inconvenience to water customers, the
contractor is directed by staff to proceed with the work at a cost not to exceed
$21,000.00.

At this time, existing and anticipated change order activity totals approximately 20% of
the contract amount. Staff recommends that Council authorize the City Manager to
increase the contract amount up to 200/0 to accommodate the change order activity
generated by this project. No further changes are anticipated and the project should be
completed by the end of November.

AL TERNA TIVES
Council may choose not to authorize the additional funding, which would expose the
city to claims by the contractor of pre-authorized work by city staff.

FISCAL IMPACT
Funds have been appropriated from the Water Revenue Bond Proceeds. The city has
issued a series of three Water Revenue Bonds to finance Phase 1 of the Recycled
Water Project. Available project funds, less unattributed interest, total $5,916,786.70
as of September 30, 2009.

~

Phong Du, PE
Senior Civil Engineer

'Xc~hfJ

Chu Chang, PE, LEED AP
Building, Infrastructure and
Transportation Director

Brian Lee, PE, CFM
Supervising Civil Engineer

Peter Ingram ~
City Manager

~

~

ATTACHMENTS
None

RELATED DOCUMENTS IN CITY CLERK'S OFFICE
None
